Our deadline to file a bond claim against a general contractor at a state owned building is tomorrow. When we reached out to acquire the bond information we were told that the general contractor is not required to have a bond unless the project is $50,000 or more. Is that true and the state of Texas? I was working with the Mortgage company as the Insurance claim paid the money to the Mortgage company. The homeowner has been using delay tactics as the home is still not finished and when he didn't pay us we said we wouldn't couldn't do any more work. We had a customer who for a few projects we did not file Prelim Notices and now they are refusing to pay, I also know that they have several General Contractors, Suppliers and Owners who are filing suits against them. We would like to file a small claims against them and am wondering if I file per project or do I just one case for a lump sum. The amount still owed to us is well over the $5,000 limit in CA, but anything is better than nothing....Read More

I have a home owner that agreed via email to a fixed price contract for floor tile installation, refinishing of hardwood floors and the installation of the bathroom fixtures. Once the carpet was removed we discovered stains in the wood floors ( my contract excluded repair or replacement of any damaged wood flooring) I gave the home owner options to resolve this issue however she did not wish to spend anymore money and had me continue knowing the stains and bad condition of the wood would remain. The evening before I expected to finish the project I emailed an invoice for the contract amount and told her I would be complete around noon the following day. At 10:00 am the next day I received an email that stated I was completely out of line and that I must have made a mistake of at least $1000.00 at this point I knew I was going to have a problem and stopped work on the project until this could be resolved. We met at the project location once after I stopped work and at that time she told me she did not want me to complete the contract and we went discussed what needed to be completed and she said she would get back to me. I sent her a new invoice that reflected a credit of 4 hours which is what I had estimated it would take to complete the contract scope of work. She sent me an email that requested another meeting at the project site when I asked her the purpose of the meeting she listed the same things that we had discussed in the prior meeting plus made comments that were personal attacks toward me and requested how I came up with the figure I had come up with for the contract. I'm still hoping I can resolve this but I need to know what cost effective legal action I can take. Thank you in advance....Read More

We were hired by a GC to do work on a state owned property. On August 28 we received a down payment and began work. We completed one of two stairwells. The general contractor terminated the contract and refused to pay. We sent the final invoice after work was completed on September 8. Originally I was told that in the state of Texas I was not required to send a preliminary notice but it was just brought to my attention that because it is a state owned property that I was required to send one and have potentially missed the deadline to so. I’m trying to confirm whether or not that is correct and if so if I am still able to proceed by sending a notice or what my next step would be . They also failed to provide the surety bond information so that presents a whole other situation ????PLEASE HELP. If not already, I’m running out of time....Read More

We were brought on-board to Manage the Project, and hire all Trades, and the owners, (Investors) agreed to pay all progress payments upon receipt of invoices from my Firm. Upon the last phase of Framing, the owners advised us of running short on money to continue, I agreed to pay the labors. in the sum of $100K to keep the project moving. However, we had about 5% of Framing to conclude, and we paid monies to the laborers as inducement to wrap up. We invoiced the owners in the sum of $100K in which they ignored us by messaging our chain email threads without acknowledging payment reimbursement. We never filed lien notices to the Hard Money Lender during any phases of the project....Read More
