I was offered a construction job i immediately made it clear that i wasnt a contractor i was a laborer that i couldnot give a bid but i could give a rough estimate so they can have an idea of the overall cost i explained that i would simply estimate or make an educated guess of how long the job would take based on my experience and multiply that by my hourly rate. More than halfway tru the job after i finished all the difficult tasks the contractor told me to stop working because the owner wasnt paying but to finish the work inside of the house. I imidiately called the owner and asked then come to find out he was unlicensed and lied to me in order not to pay me for the hours i had already put in to the job furthermore he insist in a message that we had no agreement where he hired me however he also stated that he had proof that he was in compliance with my payment arrangements from day one. Can i file for small claims or what is the best way i can get my money....Read More

I am looking for some help/advice. We currently have a client that has ordered custom shutters from us and then began avoiding our calls when we tried to schedule the installation of the shutters. We found out that the client is in a financial bind and is trying to sell the home and no longer "needs" the shutters that they ordered. These are custom and we have a no refund policy on custom products so we sent them a notice of intent to lien (through LEvelset). They reached out after this and offered a commitment to pay after closing, but I am extremely concerned that I will lose all leverage if I do not put a lien on the home. On the other hand, I am sympathetic to their financial situation and wanted to see if there was any other legal avenue that I could use to ensure that I get paid, without putting the sale of their home in jeopardy. Hi, I'm a subcontractor who worked for a general contractor that installs for home Depot in Kentucky, Ohio, and Indiana. I've installed in all 3 states. I quit Thursday and the final paycheck they sent me was one penny. You ready that right. For a full week of work over 40 hours. No reasoning, no warning. Nothing. I was wondering if a mechanic lein is the correct route to take? I have the address, phone number, and names of all the people I installed for that week and the amount the general contractor said they would pay me in video evidence. My contractor was paid for specific projects and have not even started them 7 months later. He was given money to buy my counter top slabs, but not only he didn't buy them, he has been actively lying, to make me believe he has them in his subcontractor shop, about whom he refuses to give me the location of. He has also requested and I paid him money for down payment for fabrication and cut of slabs above mentioned, that he never bought. He has also taken 3.5 months to assemble and install pre-fabricated kitchen cabinets, which should have been a few days worth of labor. On top of that, 11 of the 18 cabinets he installed were installed wrong. He said he made changes in the order but turned out he didn't, and 2 of the cabinets were the wrong size. I have him on tape saying because i blame him for all the problems to his face, he stopped caring to finish the work in my house. Also, after asking him for over a month to give me any invoice or estimate so I could get the appropriate amount of money in a loan increase so to finish construction and him providing me such paperwork in January 2019. He is now, 8 months later giving me invoices from work done since day 1 of construction, he tried to backdate them but I caught it. When I sue him, Am I still obligated by law to let him finish the work if he wants to??? How can I NOT HAVE TO allow my contractor the opportunity to correct things, otherwise he is not liable for returning my money?...Read More

If a job started over a month ago and we missed our deadline to send the preliminary notice, but we want to protect the work done for a later invoice that is within our preliminary notice deadline, can we send a preliminary notice to protect the work done for that invoice specifically? We have a contract to install underground irrigation on a multi-use building. The contracting company is not operating at full steam any longer, they are reorganizing or selling or closing (???). The buddy/ licensed / insured/Bonded contractor I was working for messed up a homeowners kitchen last weekend. I was off work but Monday am the homeowner terminated the contract. The house was 3/4 finished and nothing was paid to me. The contractor said he had received nothing as far as a draw or any payment from the homeowner. I believe this to be a lie. The contractor has a record of dishonesty, fraudulent work experience and lies. An attorney ( hired by the contractor) is working on the issue but it will be several months. My husband subcontracted a job and was delayed in getting the project done due to material that didn't match etc. Once proper material was acquired the job was finished. The homeowner didn't have any complaints as the job was being done, to begin with but now when it comes time to pay, he is making several complaints to to the general, but the general has not provided a list of repairs to be made. He has not yet paid my husband for the work done, and is trying to call a small 800.00 payment and now a 1500.00 payment as payment in full. The full job should be in excess of 3875.00 for siding alone and more for the fascia and soffit. What can be done to get paid what is owed to us?...Read More
