Sirs : With the Aid of your firm I placed a lein for $19, 332 on a Sub contractor working under a large GC for a Large State Of Mass Project( Massport) after 6 months on discussions back and forth _ the Sub makes not attempt to pay the debt left behind. I have a Copy of the Bonding company that bonded the project the sub was working on.Do I have any bond claiming rights for payment under the Primes bonding company , even thought we worked for his Sub. Our company is a contents "personal property" moving and storage facility that contracts with the insured, is referred to the job by insurance or the restoration company. We have a contract with insured, we move out their stuff, store , and move back. The insurance company on this claim stopped paying the bills because they flagged it as possible insurance fraud from the insured and the restoration company. We then had to go after the insured for the outstanding payment for several months and no payment. We then finally placed a lien on their property for the amount after several attempts. Insurance paid the customer a small check for our pack back services and the insured sent us a cease and desist letter (which has so many faulty statements) and will not pay us that check or the remaining balance, And on top of that they want us to withdraw our lien. We are in the horizontal bore drilling industry and we hit 2 water lines one of which was not marked and they are holding our payment for over 6 months now due to the water company invoices for hitting those and lines and they are trying to hold us responsible for several others that wasn't us. We didn't even receive an invoice for the ones we did hit until yesterday and there is still places we aren't responsible for on those invoices. The company that is holding our payment is also not helping the water company figure out what subcontractor is responsible for for their invoices. We are needing that payment and have been because we are about to have to shut our company down due to their holding of payment. What should we do? Hello I am an HVAC Sub Contractor in GA. I am involved in a mess. I took on a project that Consisted of the installation of Ductwork for three HVAC systems in a Commercial application. The entire job was finished and Passed the Rough-in inspection, all but a minute few punch items. My GC had no problem paying me through the job until it was time to pay the final invoice. I had no time stipulation and didnt need one because I finished the job in a very reasonable time frame. Then after inspection he wants to say that I didnt do job well Although the. Today and they told me that the claim had been paid in full so that means that regions name did not get put on the check that was only on about 4000 So there fore the customer has gotten the check for 4000and regions is waiting on us to settle the claim but they will not release the other part of the money till it comes to a settle ment so I do not know we’re that leaves me what I’m saying is regions has 8600 and the customer has 4000 and we’re does that leave me please let me know please...Read More

My client who is a sweet food store owner but not the property owner terminated our remodeling contract on Nov. 19, 2019 without any warning or discussion. I mailed the preliminary notice to the property owner on Nov. 25, 2019 in order to cover the service payment between Nov. 5, 2019 and Nov. 19, 2019. I stopped working on the project after I got the notice. I requested the service payment through phone call and text message. The client never responded it. Then I emailed her the bill of $9500 and also indicated interest rate, collection or mechanics lien could happen. I am a utility contractor. We completed our preliminary work on the project. Then the grading contractor came in to do his work. We then came in to finalize our phase of the project. Upon arrival we discovered numerous damages done by the grading contractor and I made him and the engineer aware of the damages and made necessary repairs, and calculated and shared the repair total. The grading contractor made a partial payment to me but has not paid the outstanding balance. I have made several attempts to contact him with no success. I was contracted in May of 2019 by a general contractor to provide roll-off services and dumpster rental on a residential job in Texas. After paying their initial invoice, the GC ran into issues on the project and then essentially left town. They are ignoring attempts to contact them. However, when I looked into the property record, it showed that the GC also owned the property. So, since I am contracted with the owner (who is also the GC) should I send monthly notices and use the lien process like a subcontractor or can I go straight to filing a lien here (absent the homesteading exceptions)?...Read More
