I was let go from my company while working in Alabama, 14 hours from my home in Ohio. The very small radio tower company I work for did not furnish any money for fuel, my personal vehicle(which I drove), or funds for food, etc. Prior to leaving Ohio, I was supposed to receive $200.00 per diem, which would cover food and drink. I was let go from the company on 1/2/19 and told to return to Ohio on no money. I am still on the town where the job site is because I intend on filing a mechanics lien for unpaid balance, what they owe me for the 3 weeks of work prior to returning this time. I have all the necessary documentation to validate that I worked, what was performed and also the times of which this was completed. I would like to include the cost of my hotel to stay in Alabama so I can file the Lien Monday morning, 1/6/19. I am sending the intent to Lien document to the tower owner today and have left numerous messages at his radio station informing him of the situation. I have not been paid by my company in over a month, went christmas with no money and I have a 5 year old daughter. Please let me know if you have any insight. I am trying to include the cost for my working, my hotel, my per diem ($200) and the cost of fuel I used to get down here and will use to return home. My husband is a subcontractor (Master Electrician) in Virginia and the general contractor is not paying him for two jobs. Unfortunately, he did not get contracts signed... just doing it as he goes along... time + materials. One job the payments is almost two months overdue and the other job the payment was due in June of 2019. I am assuming it is too late to file the mechanic's lien for the older job and my husband doesn't want to file the mechanic's lien on the job with the two month overdue payment because they are really nice people. The GC told my husband some months ago that the homeowner on the older invoice wasn't paying him therefore he couldn't pay my husband for the completed work....Read More

Hi! We are a mechanical contracting company in Farmville, NC. We have a customer who we installed a HVAC system for on 11/27/2017. The beginning balance was $4,550. He began making payments on 02/05/2018. He made another payment 06/14/18. On 12/04/2018, we received a letter from his lawyers to his creditors stating that he had passed away on 9/1/18. We completed roofing work at a project in Yorba Linda in September 2019. We received a partial payment because the General Contractor believed we should install something differently. We returned to fix it and sent a bill for the remaining balance on December 9th, 2019. At this point, the General Contractor is refusing to pay us until after the project has passed final inspection. He has not scheduled the inspection yet and claims that they will not allow him to do so until mid January. I filed a 20 day notice in September, and sent an intent to file a lien today. I am wondering if we are able to file the lien though with these circumstances. I asked the General Contractor to compromise by sending a payment and leaving a retention, but he refused. We are a subcontractor, that hired a subcontractor to work on three different projects. We found out after the fact that the Sub had contracted the work to another party, who then hired the end worker. We have paid 90% of our contract to our sub, but now after the work has been completed, we found out that the end worker was not paid a penny. Now that worker can not reach anyone other than us, and is now threatening to lien the project. We have fulfilled our obligation to our subcontractor (before he disappeared), but the worker is now shaking us down with threats of liens. We don't want to let a lien happen which would hurt our reputation with our customers. 1. What can we do to track down the subcontractor that we paid, and make him pay the worker that he hired? 2. We still owe our sub roughly 10%, but we obviously don't want to pay it to him until we have confirmation that he's paid his worker. If we pay that 10% directly to the worker, what can we do to guarantee that he doesn't lien the store to get the remaining balance of what he's owed?...Read More
