I am seeking solid terminology on when a retainage payment must be paid out. I have seen contradicting language and just looking for clarification. I have seen language stating "substantial completion of the project" and I have also seen language more specific to the specific work a subcontractor has completed. I am just looking to find which is correct and if we get paid once the overall job has substantial completion and or they receive the use and occupy permit or if once we complete our scope of work, we get paid....Read More

One of our vendors wrote to the Prime on a gov't construction project that our invoice was behind. They have not filed a lien - just an email. A partial payment has been made, which they have acknowledged to the Prime. The Prime is holding Pay Apps from Dec & Jan because of this and now wants a waiver from the vendor in order to release the check. I am new to this, so I'm not sure if this is all legit. I have a pay app that was due in June 20 for May work. The GC has been paid for May's work, but said he will not pay us until the end of July. The Texas Prompt Pay Act states that a GC has 10days to pay subs after he has received payment. What can I do to get payment since he is not following this? I need help in determining what kind of project I have. It is a multifamily project in Indiana. It is owned by a private company, not by any government agency. I believe it is a private project which if we wanted to file a lien we would have to send a notice after the 1st delivery of the project. Public project does not require a notice. THEY FOUND "FAULT" WITH OUR WORK - TOO MUCH AC IN ONE AREA OF THE PARKING LOT THAT HAD PAVEMENT OVERLAY FABRIC APPLIED, AND THE AC BLED THOUGH THE PAVEMENT. I am a sub contractor working on a new hanger at a municipal airport in mesquite Texas. The contractor has paid me once since I started work for Oct 2022. I am contracted for earthwork, utilities and concrete. I have not been paid for Nov ($35,000) and December ($123,000). GC states they have not been paid.
