Hello, I am currently working at ethos|three Architecture and we have a client who is managing a construction project here in Las Vegas, Nevada. We are trying to assist him in understanding his responsibilities regarding the Prevailing Wage Rates by law, guidelines, responsibilities, etc. Your assistance is appreciated - Thank you Shauna Anderson Owner responsibilities: • What is the procedure that the owner needs to go through to allow the Apprentice Bidding? • Or is the general contractor responsible? • As an owner, can they review online review of the Certified Payroll Report? • Is the owner responsible for contacting the general contract to confirm the Prevailing Wage Rates that they are using are compliant with Nevada state law? • As an owner, can they review online review of the Certified Payroll Report? What is the website? • Does the owner review and sign all payroll report that payroll has been certified and submitted by the 15th of the month. Or does the General Foreman of the GC oversee this? • Is there any legal ramification or fines if the worker is not being paid the correct Prevailing Wage Rate? • Are there any legal ramifications or fines if the worker is not being paid the correct Prevailing Wage Rate? • By law, is the owner responsible for reporting the potential violations when a worker does not report accurate hours or overtime hours when working on a job? • What process / procedure is required by law when reporting a payroll violation, etc • Do the Investigative costs fall on the owner? If the DLSE sends out the civil wage & penalty assessment (CWPA) of the subcontractor in regards to the completed project, how the prime takes an action to avoid any liability on this? If the prime/subcontractor does not respond to the state within 60 days, then the final assessment will be double with the liquidated damages? The liquidated damage is only the amount counted for unpaid wages? or for full amount of assessment? After depositing the liquidated damages within 60 days, then can the prime exercise the discretion to waive the liquidated damages and get refunded the liquidated damage later? and can the prime avert the liability of the case entirely? or still the prime will be liable on this subcontractor's CWPA? In regards to the limited prime contractor safe harbor, what if the prime fails to obtain the signed affidavit of compliance while complying other three requirements (e.g. contract executed the provisions, monitoring CPRs and taking action to rectify after being aware of subcontractor’s underpayment)? Still the prime exercise this clause to protect its side? In the settlement meeting, can the prime negotiate with the labor commissioner to avert any liability on the case entirely, at least complete the complete in the prime's side by paying the unpaid wages due? We have a job out of state. We are doing the fabrication in Florida and will ship it to Baltimore for us to erect in Baltimore. We have done a job like this previously, without any confusion we only had to submit certified payroll during the erection. Our current contract is requesting we provide certified payroll while fabricating in our shop in Florida and while we erect it in Baltimore. Hi my husband wanted me to find out how we would go about or if we could sue his former employer for prevailing wages on 2 different Naval Shipyards. NAS Port Corpus Christi, Texas and Ingalls Pascagoula Mississippi. His former employer insisted the workers get paid the rate they were hired for regardless of how much he was receiving for each of them. And then he would only pay some employees 25$ dollars a day for Per Diem. If you wanted your full $400 a week you has to pay your own hotel fees. (Which we did ) Any information would be helpful.
