If not is there a preliminary notice we can put in our NC contract that meets the criteria for the notice to the lien agent and or owner regardless of the amount, from day one of signing the contract?...Read More

We find three scenarios that keep coming up. 1st when it is a single family home and we assume it is the owner. When when we file the Preliminary notice we find out that the person who signed the documents is not the owner. 2nd when there are multiple units but it is a condo type scenario and we think we are dealing with the owner of the property 3rd when the tenant called us out and we know we are working for the tenant or it is obvious it is an apartment complex. If we have completed the Preliminary Notice with in the 20 days of starting the job and no one steps up to pay the bill can we file the mechanics lien and will it more than likely go through? I am a general contractor who conducted water damage restoration and pack out services to a home. This claim was paid through the home-owner's insurance and a pack out check was issued directly to the home owner as a 2 party check with his name and the public adjuster we hired. Homeowner cashed the check with out the public adjuster's authorization in December 27, 2019. Our company just found out about the situation and the homeowner refuses to pay us for the pack out services and used that money to remodel his house. Insurance companies usually take a while to issue checks for jobs done and once they're issued payment is required immediately. The pack out has been completed. However, the pack in was not completed since the owner KNEW he had the money and wasn't going to pay, he took all his belongings before hand. How do I go about the 20-day preliminary notice? Is it too late since payment was issued in December without our knowledge? ...Read More

When selling directly to an owner (BOE, Hospital, Church, County) do we need to file a Notice to Owner or Notice of Furnishing to retain lien rights?
