We intend to file a mechanic's lien shortly on a project in Texas. My company is a NY Domestic entity and we will be filing as Assignee of the company actually doing the work, CPE Contractors, which is a Texas domestic entity. The specific project is being done in Texas and began at the beginning of February. Texas offers domestic and non-domestic preliminary notice options. Which one should I use? I sent a Notice of Furnishing based on an old Notice of Commencement - apparently for an earlier phase of the project. After a few months of working on the job, a new Notice of Commencement was filed which included the work I was performing. Will my original notice be effective to preserve mechanics lien rights? Hello, we are a Material Supplier hired by a Property Owner for a Commercial Project Site in Ohio. It says on the preliminary notice information that "Suppliers Must Send Notice - Notice of furnishing due within 21 days of first furnishing labor or materials - or 21 days from the filing of a notice of commencement, if the notice of commencement is filed late - on projects other than single or double residences." Is it only when the notice of commencement is late? When submitting, it says it may not be required depending on our role. Also, right now, the General Contractor is not known right now. Is it mandatory to send a General Contractor a preliminary notice in Ohio on time to perfect a mechanic's lien if it comes to that? Or will just the Property Owner suffice? Thank you....Read More

A contractor (friend) owed me money. He did work on my house as a payoff for part of the money. The work included installing some stones for the house new look. Apparently the company that supplied that stone and delivered to my house did not get paid and they put a mechanical lien on my house. Am I responsible?
