On the lien template, it asks for labor/materials first delivered date. We wanted to clarify if this is date we ship products out or the date of confirmed delivery at customer’s location. The reason I ask is because our ERP currently is set up with a field to input product ship date but the delivery date is not easily accessible without manually pulling up packing slips and tracking confirmations to confirm exact delivery date. If it is necessary that we confirm delivery date, we will need more ERP development work and that is why we wanted to clarify the date needed or if we could use the ship date. And let’s say we enter a date that is a few days off from (ship or delivery date, whichever is the required date), will this put our lien rights at risk?...Read More

hello, i'm a subcontractor (warehousing, trucking and install of FF&E) and i have been trying to get a change order out of the GC since January (with no response at all)....today they asked for close out documents and I told them I will not do it until i get the change orders and we are paid on them. they finally answered me today and said the owner has had them since February and has not approved them. can i start the lien process? what it is for is additional warehousing and additional trucks....Read More

we are having some trouble at the office. when we have a customer open a sales order for material we create a prelim for $400 dollars on top of the original sale price. Once we invoice & get paid we technically consider the project done. There is cases where the customer returns and wants to add more material to that same project because it hasn't closed on their end and we also haven't given a final release. In this case we create a new sales order normally we don't prelim again. I was under the impression that the original prelim can be used to cover the amount currently open as long as there is not a significant amount over the initial value. Now someone said to me that I would have to Ammend the prelim because it is not ok to use the same prelim since the lump sum of both sales orders (the closed & Open) is significantly over the initial price. So with that being said could you advise if it is necessary to take into account the total (close & open) amounts into consideration and create a new ammended prelim or will the initial prelim cover me on all transactions currently open?...Read More
