They informed us that they would escalate our issue up the chain but we haven't received any response from them. Hello, I am a truck driver for a company based out of Chicago. I am a Kentucky resident. I have hauled many loads over a couple of weeks and have yet to be paid. They give me numerous excuses as to why this hasn't happened. I do have possession of their truck and trailer however, the same equipment that is used to perform my job. I am a subcontractor working on a commercial project. My GC and I had a personal dispute, (the GC failed to pay me for 5 months on an unrelated job for the State of Arizona, and my "letter of intent to lien" gave notice to all interested parties of their failure to pay their subcontractor- this resulted in d the GC will no longer be hired for any future projects for the State of Arizona) therefore, in turn, the GC retaliated for my request for payment by terminating the remainder of all contracts with me in progress, (all unrelated) as well as any future contracts. However, there have been two payment applications already submitted for completed work. Hello, are there any special requirements for U.S. Government (Military) projects, or does it default back to the rules of the State in which the Military Base is located? Specifically, we are an equipment vendor and installer, who was a subcontractor to a contractor working at a military base in the State of Ohio. (Military Base ==> Contractor A (holds contract with military base) ==> Our Company Contractor A is refusing to pay us the remaining balance of our Invoice. Contractor A has credit and cash flow issues, and we've found out that it is defaulting on other payments for other projects. We did not send a "Preliminary Notice" but we would like to go ahead with a Lien anyways. Thank you!! PS - We are a NC Corporation that is a Construction Materials supplier, however we can work in all 50 states (not as a licensed Contractor, but as an equipment supplier.) If you are a Construction Attorney, we'd be interested in learning more about your services so we can be better educated in Contract Law and Construction/Payment Law (and possibly having all of our Contracts reviewed prior to signing the Contracts....Read More

Our company designs and manufactures custom metal products for use in construction applications. From my understanding most states have a time limit for delivering a preliminary notice that starts at the date of first furnishing materials or labor. Since our products are custom designed, each project might have 8-12 weeks of design and manufacturing work that occurs prior to anything being delivered to the site. Is the date of first furnishing generally when the design process starts or when the product is delivered on site? And to follow up, if work is stopped and we go unpaid prior to product being delivered to the site do we have any lien rights? A large portion of our work is in California, but we deliver products all over the US....Read More

Hi , I am wondering if i have to add in a price on the Prelimiary Liens . We are sub contractors and the contractors that hire us usually mark up our costs to thewir clients. So when we add in their cost, it may show their clients the mark-up the contracters will be receiving. I am, trying to avoid this and wondering if i need to add in a price at all. OR can i send the G. C a preliminiary notice seperate with our contracted amount and then send it to the owners with no contracted amount? Please let me know ! I am a subcontractor that has done work at an hospital. They were billed back in January for the work performed. We did go back 3 weeks ago to correct a issue they were experiencing that is associated with the work performed in January. Can I still file a notice of intent and if I receive no responds if necessary file a lien. We were informed that they may be filing bankruptcy. I need to know how to protect my company from not receiving payment. I have never experience having to file a notice of intent/lien before. So I don't have a clue where to begin.
