I have a contract to perform work on a project as a Subcontractor. Our contract states that " all work must be ready for the Subcontractor to complete all their work in one trip when the Subcontractor arrives on site." We were called, demanded and threatened with law suite, to come to the job and the GC did not have the job ready for the US ( the Subcontractor) to complete our work. The Site Superintendent assured us that the job would be ready when we arrived at the site. We got to the job 12:00 PM got our crew rooms and arrived on site at7:00. We are roofing contractors when we arrived the steel decking was not installed on the bar joist. The site super said his steel crew over slept and did not work last night. Short story. When we billed for the extra trip, overtime per diem, the GC is now saying the invoice is extra ordinarily excessive. Looking for advice to lien property. Hello. We're doing business in California. When we have a contract with the Owner of a job, do we need to send a Preliminary Notice to the owner? Or does the contract take the place of the notice? Additionally, if there is a bond on such a job, and I send a notice to the Surety Company, do I list the Owner and General Contractor on the notice, even if I'm not mailing notices to those entities? Its been over 8 days since I provided my services and I havent gotten paid because the general contractor is refusing to pay the guy who hired me. The renovation costs are backed by a lender, however there is an overage amount due to change orders that the homeowner is personally responsible for and so far is not paying. I started remodeling a house for a contractor. I received preliminary lien notice within 20 days of first lumber delivery. The contractor did not provide lender information to supplier even though contractor signed an agreement with lender. Lumber company asked me when I inquired if bill was paid. I provided lender information to lumber company and preliminary lien was sent 5 weeks after first lumber delivery to the lender.
