My husband and I hired a local company to pour our driveway. We'll call him "Mr. Fix-it". Mr. Fix-it poured our driveway as we agreed, did a good job and we paid Mr. Fix-it the full amount per our agreement. Today we received a letter from the concrete company stating Mr. Fix-it has not paid the balance of what he owed them. They advised that they will put a lien on our house if the balance isn't paid. The letter said Mr. Fix-it is not returning their calls. They asked in the letter to contact Mr. Fix-it to get him to pay. I called and advised that they cannot file a lien against our home because the agreement was between Mr. Fix-it and the concrete company. Their agreement has nothing to do with us. the contractor and I have had text arguments over the supplier not being paid and over him doing some additional work to finish the deck which I have now finished. the money involved is about $3015 I have contacted the supplier and put them on notice that I think he has not paid them and wont but I have not heard back from the supplier. my guess I will receive a lein notice. We have been using Zlien's services to process liens for non paying customers. However, most of our customers DO NOT own the land where the mobile home sits. They rent the space instead. We are now having to release the liens after the park owners have asked to do so for obvious reasons. Do you have any suggestions on how to best solve this situation? Is there a way for the lien to be placed ONLY on the actual mobile home even if it may be considered personal property rather than real property? Good morning, This is Soo from Exbon Development Inc. I have a question in regards to how to file a payment claim to one of subcontractors which is not corresponding their labor/material work despite their scope of work. We have a subcontractor which was executed subcontract agreement for CA state public work project. This sub was irresponsible to perform their work, did not correspond with us and unsuccessfully uncompleted their work. Most likely they vanished at site. Due to their incomplete performance, we had to hire another subcontractor to cover their work and process material / equipment costs. Such costs are exceeded their contract amount although we back charged in their contract amount. Therefore, we would like to file a payment claim to them to collect the owning monies.
