I was working a residential bathroom remodel, the contract was for 22627.01, including tile cost when selected and with change orders and additional work, verified through emails and verbal change orders the total became 27752.78, I was paid intermittently total of 13000. when it came to 1 more day of work to just knock out a very small punchlist, the night before I asked for 10000 and allowed him to hold a retainer of 4752.78 until the next day when i completed the job and he was happy. He denied the 10000, wrote a check for 2000. then the next day, I was told that I was not allowed back to the property and that my workmanship was unsatisfactory. Then he offered 2900 only if i signed a letter of dissolution. Hes now threatening to file fraud with L and I. all the supposed poor workmanship was the things I had on my punchlist, The bathroom is absolutely beautiful, Ive showed pictures to alot of people and everyone agrees that its a great bathroom and the amount of work I put into it is close to 300 hours. Throughout the process, there was never a single complaint and his wife even said multiple times that with my work skill and knowledge of processes and supplies I should have my own improvement show or broadcast on youtube. But the day before it was time to settle up, my work all of a sudden was unsatisfactory. pictures are up on my website. www.waunatile.com under a.d.a. compliant remodel. this guy owes me almost 13000 and all my prices are completely justified, hes making up prices for my business, what do I do, I have 400 to my name as all I had went into this project....Read More

I have a customer that I have filed several liens on in the past. They have bonded around every single one of them so I sent a demand letter to the bonding company about 2 weeks ago. I have not contacted them yet. I figured Id give them this week and them start calling. but my question is, is if I cant get anywhere with them what is my next step to get paid? file suit? this over several different states....Read More

We did a small turn and was supposed to be paid 1000 that Friday for our work. My husband and I worked under mark, he worked directly for a company named Conrax. Mark is just a gc as well, so I guess we were sort of his crew, but we had separate houses we were working on. Anyways mark didn’t pay that Friday said computers went down at the office. This was two weeks before Christmas. The week before Christmas we put a bid in on a house for 1340 or so, I have exact numbers. And we were to be paid the Friday before Christmas. We met his wife, she handed us a envelope with four hundred dollars in it and drove away. We usually get a check from them. The amount we were to be paid was the two weeks worth of work. We asked him had he made a mistake, he got mad and “fired” us. I have many texts and messages discussing prior to that, what was to be paid, what was owed and so on. My proof is what I call it? I got ahold of conrax told them I was filing a lien explained the situation. This was right after Xmas I talked to them, they said they’d contact mark and the higher up and get back to me. That very night, mark calls cussing yelling and screaming. His wife messages me asking what we’re owed, saying marks job is at stake how can she fix this and make it all go away. We also received threatening messages from on of marks actyal crew members. Today I finally herd back from conrex, they said since he had been paid out for the houses they can’t do anything bc mark claimed we had been paid everything we’re owed. They wouldn’t even look at my proof, and he still has his job? They pretty much said all I can do is sue mark. Even so, he won’t pay what we’re owed. Because he has done this, we’ve lost a lot. We have three children and bills just as everyone else, as I said we have a LIST of what we lost it wasn’t just the money and our main source of income. I need to know my next step. At this point hiring a lawyer isn’t a option due to not having money, even so, we wouldn’t get our money plus lawyer fees and court costs. And even so at that point if all worked in our favor, mark would never pay. I am not sure what my options now, I have someone I know who’s been in this business for 40 years and says to file a lien reguardless. Any information you could give would be very great. I hired a contractor to paint the interior of my house and I agreed to provide the paint, and all other supplies. I purchased 2 five gallon buckets of paint for the walls and then an additional five gallon bucket for the ceiling. 6 tubes of caulk and 6 rolls of tape, 6 paint roller covers and 10 paint trays. My house is 1281 sq ft. He started on a Monday and when I met up with him on Saturday ALL ten gallons of paint were used and hardly any of the ceiling paint was touched. All the tape was used, none of covers or trays used. And only half of the caulk was used. Unfortunately he had only done ONE bedroom completely, the second bedroom was originally white and only had one coat and it was all streaky. The hallway was a disaster. The master bedroom had two coats but needed the trim to be completed. Then the dining area and kitchen were spotty and the living room was untouched. Now he is wanting $1980. The paint itself was over $400. I had to fire him as he had only done two things right. Patching the walls and caulking some of the baseboards, not even all of them. What are my rights?...Read More

california General contractor was hired for whole house remodel, collected 20% deposit and was to be paid in phases upon completion of work. He kept collecting advance payments (taking advantage of someone who didn't know how the process worked). He was explicitly asked why he was taking advance payment and that it wasn't working out for us this way and he replied that it was the nature of the remodel. Took way over the proposed time frame and ultimately abandoned the project leaving a lot of work to be done. Refused to come back to work citing "money owed" however the money doesn't correspond with the actual work completed. He filed a mechanics lien, we filed a cslb complaint and a complaint with the bond company. Bond company says we terminated the contract because we refused to pay him, even after he abandoned the project we met with him to give him opportunities to come back which he refused to do. What is the most appropriate way to prove that he abandoned the project and what violation codes can be cited? He left the house in shambles with a lot of HVAC and electrical hazards/issues including a lot of shoddy work that needed to be corrected. He told a neighbor that he was using this as a “fill in job” because he “underbid”....Read More

I'm a family member I paid 250 a month for a small room and 300 towards groceries and the only reason I'm asking this is because I wasn't there a couple of nights I slept over my girl friends basically i did some things around the house to help and was taken advantage of. Hello, We completed a project more than 150 days ago. We were approved for a change order for additional work by the General Contractor in writing. The General Contractor is refusing to pay us because the project Owner is refusing to pay them for our and other subcontractor change orders. We were just informed of the project Owner refusing to pay. Up til this point we were told that all parties were working on it and that payment was expected to be made. I understand that the State of Wyoming requires that the mechanics lien be filed within 150 days from last working on the project. This date passed before we were notified about the Owner refusing to pay. I spoke with a different general contractor and they think that because we were told that we would be paid up until after the 150 days expired, that the 150 days to file a lien should start essentially now. Hi, I want to know the process I must take. Our company was subcontracted to do work. The contractor signed a proposal that agrees to deliver full payment upon completion. It has been 3 months and we still have not received payment. every time we ask he gives an excuse saying he didn't get paid yet. Which is none of our concern because that wasn't in the contract. I have read from multiple sources that for Arizona owner-occupied residential projects, "Only parties who have a written contract with the owner-occupant may file a lien against an owner-occupied residential project.". Does this mean that a subcontractor who is only in contract with the prime contractor does not have lien rights? If so, what alternative recourse does the subcontractor have to recuperate funds owed?...Read More
