Contractor was supposed to concrete off tube going into pit. He decided to excavate my yard to get at the pipe that way. There was no way to seal it off that way as he ripped out the piping that went to basin to seal off. Then he proceeded to still not bring the cement to do as I asked from the start, but twice brought plugs of various sizes that didn’t work. He’s wanting me to pay him $1500 for all of this when no fee was discussed as he said don’t worry I got ya covered. And what I requested to be done was never even done. We are a small South Dakota contractor in the fiber optic splicing field. We subcontract from Prime (general contractors) The project we worked on was a Federally Funded Construction Project (RUS) in Iowa. The prime contractor is past due one year on approved invoices of $129,000.Last payment on this project was last year Sept 2019. What about Federal Prompt Payment in this situation? The prime spent months trying to demand we sign off on invoices with lien waivers that we had not received payment. We did not do as they owed this extreme amount. After this was unsuccessful. About a month ago, the prime contractor has now sent us a claim of unsatisfactory workmanship. There has been no mention of this terminology prior to a month ago. As this was there last recourse for non payment of past due invoices. Don't they have to prove this statement after this length of time? ...Read More

Description of situation I went to called me up and went to her house diagnosed her car it was an hour I don’t want to go in and finish another job or to my shop and I turn on and pulled off to the individual call Pat another one bank and turn around I tried to turn on replacing a boot on it that didn’t work so it was the coil pack that need to change it’s taking her almost a week to buy a coil pack or give me a call back finally got one she lost the key to the car now she’s so ironic you so I said whatever the case may be I don’t know but she doesn’t want to pay me the labor for the car isn’t it it’s a minimum of an hour call out fee plus the 30 minutes short of the diagnostic at her house right here is probably about another 30 minutes just to change...Read More

I am a landscape contractor, working on a small residential garden project in San Anselmo CA. Contract total is $18,500. I have installed 95% of the project, but cannot complete the 5% balance (aprox. 10 plants w/irrigation pending) because the homeowner is waiting on a permit to complete some home repairs that would impact the landscape. I have the balance of plants in my posession, have been caring for them pending green light for installation. Payments total $12,250, balance due is $6250. Over a month has passed since we pulled off the job, and there is no permit in sight. The homeowner is holding withholding $3000 of the $6250 bal owed as retention, indefinitely. My contract states: c. Delays: Contractor shall be excused for delays or defaults in performance of Contract caused by Owner, acts of governmental authority, acts of God, inclement weather, war, commercial shortages of required labor or materials, litigation, labor disputes, Additional Work, failure of Owner to make prompt payment, or other contingencies beyond Contractor’s control. Im a sub for a sub that did work on a government project on Nellis Air Force Base in Las Vegas Nv. The last day we worked was on was April 20th, 2019, the job was put on hold due to mold being found in the dorms . We were originally supposed to just open the fire chases and walls to give the plumber access to the cracked drain pipes and repair the opening, texture and paint to match. When we open up the fire chases we found that there was damage and holes in the walls that was done by some previous repairs, We were instructed to repair the damage and holes and to fire caulk all pipes, we were sent hand drawn drawings on how to do the repairs by Ellard Comstack who was the senior project manager at the time , i never got a change order, i just hand wrote a paper with the price and Ellard signed it as a letter of intent and I just last month went to Tuscan to get a statement from him that says Yes he did tell me to do the work. The job has now been cancelled and it will be rewritten and will have to be rebid, Northcon was not asked to return to bid that job and we instead were asked, Northcon now refuses to pay us, they owe us 58,000.00 for the extra work.
