I am a contractor and i finished a project in September 2018 and still haven't been paid. I was not aware of the mechanics lien until it was too late. The client was unhappy with the work in regards to the heating on a room addition, however we were only responsible for connecting the heating vents, not the power of the heating unit. We already went out to see if there was anything we can improve in the vents, but the only solution that we could get was for her to buy a new heating unit. She refused the solution and puts all the blame on the contractor. We have been giving her prompt payment invoices, but she ignores all of them. I was thinking of taking this to a small claims court. Any help will be appreciated, Thank you

IllinoisWe are building a new construction in Tennessee. We have made all requested payments to our contractor on time. We are now receiving calls from subcontractors who completed work on our house, but our contractor has not paid them. Are we legally responsible to pay these AGAIN since we have already paid our contractor for said work?

Now that it is time for him to accept the final payment, he refuses to. All the bookkeeping and calculations are in full detail and correct, but he continues to disregard the evidence and demand he is paid more without reason. Can he put a lien on the house if he is not paid for the overcharged amount he is asking for and if so, can I fight against it to show he is abusing the power to put a lien on the home??

FloridaI did some work for a company BR Linwell who got a contract for doing some sports equipment installation at a college nearby since the project was state/federally funded it was a prevailing wage rate job. (Pennsylvania) I kept getting the run a round from my boss saying he was waiting on payment from the sporting equipment company (knights athletics). I’m a 1099 worker. PennsylvaniaWe are a remediation company. We did work about a year ago for client. Public adjuster on file. We received the initial payment from the client last month but are still owed the remaining balance from the client. We have discussed and agreed on a payment plan & sent the client a contract to sign. The client has not the sign contract back & the 1st payment is due on 11/16/2020. I have called, text & emailed the client with no response. Can I speak to an attorney? & are these general attorneys or are they specialized in this field.
New JerseyWe were a subcontractor on a federal project, our client (the general contractor) hadn't paid us our final payment in now over 120 days. We just received a partial payment from them as well as a "deductive MOD" to our contract in which the deductions they are stating are not plausible. How do we proceed in getting paid? Californiai was awarded a project this monday 26th and was told going i was going to be receiving the container of tile today which is 10-29-20.i scheduled two guys for 7 days .wednesday afternoon i was informed that they wont be needing after all.I told them i spent money and tile and scheduled the guys.PM stated to send him an invoice to make myself whole.I dont know how to word the invoice so i can get paid.
CaliforniaWe completed a home renovation where the contractor walked off the job, filed a lien against us, and then filed a lawsuit. An attorney friend recommending settling to avoid the cost of court/arbitration.
After the settlement was signed we learned that the contractor (and his attorney) were intentionally holding back payments to the HVAC subcontractor and tile/flooring subcontractor. The HVAC contractor contacted us directly and specifically stated the contractor and attorney are not responding to him. The tile/flooring contractor actually sued the GC after we settled.
The problem is, these amounts were never disclosed to our attorney or to our bank via the Affidavits per payment. It would have changed our mind about suing since we could prove fraud.
I'm not sure if the contractor can claim this is a dispute between him and the subs and therefore isn't required to be disclosed to the bank. I believe (I'm an foresnic accountant/CPA) it's fraud since they filed a lien and lawsuit based on false/represented amounts. I'm on the fence of reporting to the police and/or suing for fraud in obtaining a settlement.
OhioI filed a lien just over a month ago and have not had any correspond with the homeowner. Is there anything more I can do before my lien expires? My contract with them states we will settle disputes with binding arbitration, Is this my next best step or should I hire a lawyer? Peter
