is 20 days: 20 working days or 20 calendar days? We have never worked for a developer before and began work on a project that the City of Riverside owns. We never filed a preliminary notice as we are used to dealing with city and utility company and have never had a problem with payments. This developer is now balking at paying us. Now, the attorney for the owner/building is trying to bond-off the lien by claiming that the lien is illegal. I am a material supplier and filed a stop notice for a job with the County of San Diego and received the following message: "We have received your legal notice under Civil Code Section 9350 et Seq., dated June 19, 2020, claiming an amount due for work furnished to Prime Contractor (optional Power and Cable Solutions) pursuant to a public works contract. The legal provisions cited in this notice are not applicable, because the agreement between the County and Optional Power and Cable solutions was for a purchase of goods and not a public works contract." Also, A Third party company placed the order for the County, and the county installed the materials themselves. The county did not require the third party company to provide a performance bond. Was I supposed to file a lien instead of a Stop Notice?...Read More

We are working for JE Dunn doing the demolition in phases for the remodel and expansion of the San Marcos Library for the City of San Marcos, TX. We started work on February 18, 2020 which was a time and material change order to our original contract. It took JE Dunn February, March and part of April to issue the change order that they signed our CO proposal for the work. We also did work related to our original contract. We billed the change order (which was finally issued and per JE Dunn approved) and the additional work we did on April 21, 2020. We have not been paid for this work. We are looking at 45 days since pay app and no money yet we started working in February. JE Dunn has provided their bond information. What are our options?...Read More
