I contacted a contractor that had done previous work for me about another job. We talked over the phone about the project. His employees came and completed the work in one day. The work was horrible. He then presented me with a bill that was more than double what we had discussed on the phone. I refused to pay the amount he gave the invoice for, but agreed to pay the amount he discussed. I own a Landscaping company that uses a temporary service company for some staff on my jobs. I notified the temp company about his death and a day later the company sent certified preliminary lien notices to all of my customers. I owe the temp service less than $2500 and I am not even 30 days past due on any payments to them. We're a subcontractor that did work on a project for a Native American tribe. The General Contractor is no longer responding to our emails or calls. There is still money owed to us which we have billed through signed change orders and a signed contract. We don't necessarily want to take action against the tribe as we know how complicated that would be. What we do want is some document directed toward the GC which we can also send to the tribe to get everyone's attention. I entered into a contract with contractor for work. I gave a deposit for 20% ($100) that I though was for agreement to do work. The stipulation was the company had backlogs and I agree to 4-6 weeks delay. At week 5, 6 and 7, I sent numerous requests through their answering service and email requesting a date of work to be done, to no avail. I finally said on the last email, if you don't contact me, tonight, I am cancelling the job. I finally did receive a call 4 days after my email requesting the job to be cancelled. The person calling was rude, intimidating and said if I want out of the contract I have to sign a "resolution agreement", meaning he holds my deposit unless I say I will not, "file any outside complaints, posting negative or verbal slander originating from me and will void and reinstate original contract in full." Since I refused to sign such resolution which I believe violates FTC rules and the Consumer Review Fairness Act which prevents business from demanding such an agreement, he now threatens to take me to smalls claims court (for my $100 deposit which he still has), place lien on home and sue me for the full amount of work that was supposed to be done ($509). I understand, keeping my 20% deposit but suing me for the full amount for work NOT scheduled, Not started and/or Not completed? I sent three emails saying I do not want to do business with his company. I believe that is fair notice to resolve and show my intent, no? Can he sue me for the full amount of contract work not even done? Thoughts?...Read More

I started my own electrical business this year. I have a contractor that I’ve been working for on a job at an apartment complex for about 6 months. I have known the company for a while, I did work for for them while I was with my previous employer. Completed everything that was in our contract yesterday. They asked me to come out today to fix something else but I told them I could do that but I’d have to make a change order, I have already done a ton that wasn’t in the contract but just let it go. Today the contractor called after I sent him the change order and first tried to tell me that he wasn’t paying me until the extra work was done. When I replied letting him know that I couldn’t afford to come work for free and that everything he is paying me for is complete, he then said he wasn’t paying me anything and not to go on the property, I’m fired, that his lawyers are a lot bigger than mine. I spoke to him on Monday and he told me that he had my invoice in so that I would be paid this Friday through payroll, as I have let him know weeks ago that I have been struggling to stay afloat in the last month or so due to the coronavirus. I submitted two invoices for jobs that I assumed I would probably have a hard time getting paid from, and I was right. They have tried extremely hard to keep from paying me. I filed an Intent to Lien and the customer supposedly authorized payment. The property manager now supposedly has the check, but keeps finding excuses not to mail it to me ("lost it on the reception desk," "wrote the wrong address," etc.). I don't believe this check exists, and I certainly won't get this or any check from them until I take action, rather than make hollow threats. Can I file a lien, even if they actually do have a check ready for me that the bumbling idiot property manager keeps forgetting to mail?...Read More

Good afternoon, We are a general contracting company in Texas and did some plumbing service calls on an apartment complex with multiple individual owners. Each unit is owned by a certain individual. They are run by a board of directors, and that board has a management company they have hired. They have not paid for some services dating back to January 2019. I was going to send an NOI to each owner unit we have done services on. The owners don't know about what's going on, as they believe their money is being used for the good of the property and paying the bills. So if tey get an NOI, they'll be surprised. I have a contract on the Job. He owes me $3,900.00 . I have before and after photos of the work done and it was done right. The house has water damage causing the 40yr old popcorn ceiling to crack (8 inch crack). The painting of the ceiling caused the crack to expand 3-4 inches wider . Home owner trying to blame me for his ceiling crack. Fixing this crack was not in the contract. Owner also complaining about a rust spot coming through the new paint. (a 5 min. fix) His Emails indicate that he does not plan on paying me in full or possibly not at all. I imagine he will try to talk me into accepting way less than he owes me. Can I accept partial payment and then go after him w a lean for the rest? I he makes me sign something to let him off the full payment can I sue for blackmail?
