I had moved in with my daughter to help with the house payments... I was going to move to Hawaii but I wasn't ready and all my money went to her for the house..All my thing were at her home and when things didn't work out she dumped me on my xmotherinlaw...the corona hit....the island closed and is still closed...I have an apartment now in Memphis Mi and want some of my things I left at her house ....I sent her a message on 1/29 stating to bring the small things to her grandmothers and the rest i didn't want....sent her an email stating what I wanted...Her grandmother just told her to bring her my things..my daughter said there isn't much....I think she destroyed or threw my things away....my photos of my travels to Hawaii severl time....europe etc...all my photos family etc on big box that was in her room stored under the stairs.....anyway some things that can not be replaced....can I give them a net worth and through a lien on her house?????on her personally?there also is a gem stone collection worth over $5000 ...Read More

I was working for a Contractor on a job site as an hourly subcontractor when the contractor told me he was going to severely under estimate the amount of hours from 80 that I had put in to 50, I walked off the job site immediately, I have proof that the kind of hours had absolutely nothing to do with my performance on the job site, he was simply trying to stiff me, do I have a right to compensation for the hours that I worked, can I obtain this through a lien, and is it a good idea to contact the homeowner personally before submitting a formal notice of intent?...Read More

I am trying to find out if there is a legal document or process that I can provide or go through in order to prevent my subs vendors from filing a lien, when subs have been paid... Legally speaking, if a vendor files a lien or sends an intent notice do they have to provide payment records to me? Do i need to supply payment records if I don't have a Conditional lien waiver? I work for several entities that are development companies. Additionally, we are the part owner and the GC. We are a small company that has grown rapidly within 5 years. I have received intents to lien from various vendors of our subcontractors, whom have been paid but have not paid their vendors. If i do not have a conditional lien waiver for progress payment executed what do I need to provide the vendors inorder to prevent lien? Our contracts state the subs are responsible for their materials, tools, supplies and equipment costs and that amount is to be included in their bid packages- so when we generate and execute a contract the subs and my company have a meeting of the minds that they are responsible for covering their vendor fees. Am I missing a step? Should conditional lien waivers on progress payments be executed at time of contract execution? Are their any documents I should be providing and having my subs execute in order to prevent liens? ...Read More

Contracted to supply vertical turbine pumps and start up services once pumps installed. Pumps supplied in November 2020. Pumps are supposed to be installed June 1 and startup services are to take place. They have paid progress payments but are holding last 10% . Is it too late to file a Notice to owner? This is for a City in Oregon. We also supplied pumps for a 2nd part of the project and that is not scheduled until 2022, but they have our equipment in storage. Since the owner has called a couple times I have taken care of there service request in the hopes my good faith would get them to pay up. I filed an intent to lien back in September of 2020. There have been no payments made in over a year. Hi, I'm a home owner in Los Angeles County (California) and trying to refinance my 1st mortgage. The lender has done research and found a lien on my title from the Geology company ("Action Geotechnical Consultants"). I have never heard of this company and the lender has provided only a name for me at this time, no contact info. I could not pay them even if I wanted to. Project started on October 20, 2020 We are the prime on the project and hired other subcontractors to fulfill the needs of the emergency services. last day on job was dropping off couch/contents on march 25, 2021. All charges are a little bit over $25,000 homeowner is refusing payment saying these charges are unreasonable and not consistent with industry standard, when they are 100% reasonable and it is industry standard xactamate team line items we get paid for on every job. Except this is a liability claim because his neighbor leaked into his house and they are not paying for any mold work or any virus work there are exclusions on that. He is also stating that I do not have a legally mandated written contract that is required under California contractor state license board. We have an emergency services authorization. There is no way to even get close to telling what the damages were before the job was started. Same thing we do on every job. I issued intent to lien and intent to foreclose paperwork a month or so ago but chargers were still ongoing as we were still storing his couch. Can I retract those in issue a new intent to lien with the new total. I know he has received money I think a total of 18 or $19,000. The homeowner mentioned that it was around $6000 less than my billing if he would eat half of it would I eat half of it. I told him I can take 10% off anything more than that could be considered insurance fraud. He wanted me to eat $3000 the 10% off was around $2500 and all communication has failed since then. He did reply to my payment reminder saying that I am overcharging and adding O&P when it is not warranted. The white paper from Xactamate states that overhead and profit is warranted. We have made multiple attempts trying to call the owner and several different other people that pertain to this project, but as of yet no response. We have not sent any prerequisite documents (Conditional Waiver or Prelim) but do need to move further with this account.
