The homeowner we have filed a lien against, and are waiting the 60 days for any contesting, has recorded a new Notice of Commencement for a new roof. My question is, is he allowed to do this AND does it affect our lien.
FloridaWe are a solar contractor who would be working with our customer to install a Photovoltaic System but the homeowner decided to cancel. We have a signed contract that stipulates if she cancels after our cancellation deadline, she would be charged a cancellation fee. We also have a signed Notice of Commencement that has been notarized but not yet submitted to the Clerk of Courts for recording. As a company are we within our rights to purse a mechanic lien?

MichiganWe are the CG on 2 public school projects in Ohio. The projects that are already recently started, but I cannot locate Notices of Commencement on the respective county recorders' websites. Should I still file a NOF immediately or wait to see if the produce an NOC? Since we are the GC should we file the NOC in 10 days if the NOC does not appear to be filed? Or would we need to be specifically asked by the school to be an Owner Designee? In that case should we also file an NOF or just NOC? Also do I need to obtain bond information and how? We are bonded, but I'm not sure, should the need arise, how we would make a claim against the public bond without the info.

OhioWe are homeowners in Fort Myers building a pool. We just learned of the requirement to file a notice of commencement, but the work has already started. The general contractor signed the application for permit without our review or signature and therefore we were not aware of the requirement to file a notice of commencement. Should we finally late NOC?

FloridaI have a lien that was filed through Levelset and I got a Contest of Lien notice from the homeowner which moves up the time in which we need to file a Commencement of Lien Action. We received the Contest of Lien Mar 3, 2022. Need to consult with someone about what to do next and fees.
GeorgiaMy Contractor has abandoned my new residential home construction project. As a residential home Construction Customer, with an extended Construction Loan, my Bank is in New Mexico, and my new home is in Georgia. The Bank states an Attorney can help me comply with Georgia's process of replacing the ex-Contractor on this project. What are all the steps required to replace him? Is an Attorney required to replace him?
GeorgiaWe have recently began using Levelset and we were told that notice of commencement is only to protect the general contractor from the supply company or sub contractor from also filing a lien, but because we know that it will not be a situation for us it is not required in our case. We want to make sure that we aren't missing any necessary steps to secure that a lien can be filed.
Please note that this situation pertains to jobs in GA and SC.
GeorgiaI am a subcontractor with a client that is closing their doors soon. Most of my projects are smaller $500-1,000 and as I understand it, do not qualify to file a lien in Florida. They now are indicating they intend to pay two of the large($2,500+) projects because they are qualified to file a lien. Do they get to decide how the payment they send is applied? or can I put any payment they send against their oldest invoices and call the larger projects outstanding?
FloridaI know and NOC is good for a year in Florida but do you have to start the project within a certain time of the filing? Our customer wants to be present when the work is done and it has been delayed since June for various reasons. The NOC was filed in June when the work was originally scheduled to start. Just trying to figure out if we need to refile the NOC or not.
FloridaAre we responsible to apply for a SC Notice of Commencement? If we choose to create a SC Notice of Commencement can we do that from Level Set or will we have to file in the county we're working? From what we've read it's not a requirement, is that true?
AlabamaI sent a notice of contract to a homeowner . While I was filling out the contact information I added the current name but it seems like levelset automatically added the ex wifes name who has passed away on the letter and we weren't aware until the homeowner received it. Legally will this affect us if just the husband signs? or would we have to send a new letter ? and how would that be in regards to the date?
