A contractor I hired did not pay one of his subs. The job was completed and we closed out payment with our contractor. Unbeknownst to us, he had subbed out part of the work, and never paid the sub. The sub has now sent us a notice to lien. We called the sub and they explained they have not been paid for their work and the contractor has been dodging them. I have a contractor that's initial bid was $1750 for a project, they increased it to over $4,000 and are now threatening to file a lien. In addition, the initial contract was from company a, the nephews uncle's business, but the final invoice was from company b, the nephews company. What are my rights? This seems completely invalid. They're basically of the mindset that the initial quote doesn't matter and we should pay them for whatever work was completed, which apparently they can come up with whatever they want after they start work, and just put a lien on our property if we don't pay it. Company has been formed for less than a month. Basically an 8-hour job turned it into a 15 hour job with tons of extras. We're prepared to pay for some of the extras but not everything. ...Read More

I'm a subcontractor working on a large project. We finished work and are not receiving final payment even after filing a Mechanics Lien. Our Mechanics lien will expire in 9 days. We contacted a lawyer and we were advice to do not make the Mechanics lien effective as the amount of money owed will be simnifically less due to all filing and lawyer expenses. We were advise to wait for contractor to fix the problem as they are also going in a legal matter with client. We were told that this was the best practice because we still have 4 years to enforce contract if non payment is received. However, I would like a second opinion. Contract balance is for $30,107.00. I am a painting subcontractor and hired by one of the 4 owners to paint house and a verbal agreement was made with no deadline and told no rush so within the week I began the job and almost two weeks in I was told to pull off the job along with all my equipment and supplies and told that they had renters and didn't want no work being done come to find out that one of the owners became upset because he felt that the work was going to slow keep in mind that I'm only one guy painting a big 2 story"30ft high" beach home with equipment that I am setting up as in scaffolding to reach by myself so they decided to fire me but not telling me exactly instead have been telling me next week Everytime and my intention was to have done before Christmas which at the time was a month away so I had plenty of time and again no time frame was told just told no rush plenty of time . I'm only one guy so I take jobs and have to give up jobs when I'm working on one so that I can finish one without interrupting another then when finish I am hopefully have another scheduled but after the past couple years of everything going on in the world it's been tough to get work and everything I do I get by recommendation and just word of mouth because I give good prices and do good work and am generally a good person and courteous to everyone so people like me but now I'm in a bind about to lose my place of living and not have Christmas for my family I have 2 little boys and my wife is stay at home mom and my secretary to keep our business in check the verbal agreement was to paint home one coat on white and two coats of white over the yellow I finished prepping entire house and washing certain areas that were mildewed then finished the second floor completely on the east side which is the longest and most work along with the back porch area and most of the front second level porch area I have pictures of everything they paid 2500 for the down payment and my equipment rental but now I'm left hanging and waiting to get started back only to find out fired and I have been waiting for 3 weeks do I have a case thank you ...Read More

We are a material supplier for a project in Silver Springs, MD. We are not the manufacture we are a material only dealer for the manufacture. We supplied material May 27, 2021 and last supplied material on June 30, 2021. Sometime shortly after the material was installed we were notified of a defect with the material, at that time we had not been paid for the our May invoice. We did send our Preliminary Notice to everyone on 8/19/21 and we also set our Notice of Intent to File Lien on 10/21/21 both via Certified Mail. Fast forward to now and the manufature agreed to remake all the material for the project at no charge, but they excluded the cost of removeing and reinstalling the new material, which will deliver on 3/16/21. There is still uncertianty as to weither the material is actually defective or if it was an installation issue. Right now we have still not been paid for the original material, but somehow we still need to protect our lien rights. Levelset is telling me we have to file our Perition to Establish Construction Lien by 12/27/21 in the circuit court via a Maryland Attorney. Obviously this is a complex situation with a lot of information all at once, but we would like some guidance and ability to hire a Maryland Attorney that specializes in these types of situations. ...Read More

If I put the incorrect amount of the claim in my Notice of Intention to Lien, and I am still with the 120 day deasline to file the Notice, should I amend the the notice to the correct amount, or just issue a completely new Notice with the revised amount? We are based in IN and we have a customer in IL. There was no signed contract or preliminary notice, but we do have the customer's signature on a change order from mid-job. Is there any way to file a partial lien on the amount of the change order? The work was done in 2019. Have we missed the window entirely?
