Texas Fraudulent Mechanics liens file on property Buyer #1 wanted to buy a lot that was contracted to be sold to Buyer #2 . Buyer #1 file a Texas Fraudulent Mechanics liens file on a vacant lot ABC on the day of closing a contract on Buyer #2 . Thus Title company not able to close the deal for Buyer #2 because Buyer #1 file lien on property ( vacant lot ) that Buyer #2 was about to close . Owner of lot ABC NEVER ask for Buyer #1 to provide any services . Buyer #1 is a contractor and this contractor purchase some lots from said land owner. Buyer #1 wanted to buy lot ABC but Owner already put under contract lot ABC with Buyer #2 . I recently completed some remodel work for a commercial space for someone who just signed a 5 year lease. The goal was to complete the task by Dec 1 and we weren't able to get him in the new building until Dec 6. He is now refusing to pay because we missed the deadline. There were some additional tasks he wanted us to complete on Dec 18-19 which we took care of. There are still a handful of touch ups that should be completed but he doesn't want us to set foot on the property again and is now refusing to discuss a fair payment for the work completed. I have $40k out of pocket expenses and approximate $60k for the total bill. What are my options? ...Read More

I was Subcontracted through Angie's list to do a hardwood floor patch in the living room and replace 2 boards in the kitchen then refinish the whole floor for $2000. $400 up front $550 after the floor was installed then the remaining when I finish. When taking out the 2 boards in the kitchen I seen the subfloor was damaged due to a water boiler leak so I tried to contact the homeowners to see what he wanted to do about it before I pulled out more floor. It took him 2 days to get back to me then we agreed to do the minimum possible for a additional $500. When everything was patched up and ready to get sanded he had already payed out $1505 and all of it was put into material for the project and When I asked for $550 so I can rent the Equipment I was gonna need to sand the floor he didn't want to pay it. The following day when I went to go put in some Transition pieces I found that the locks were changed and I couldn't get in. Then he's dad told me there's a new floor guy that was supposed to show up that day and never did. I asked him to pay me $500 for my labor I get no response. The project had been delayed a few times due to me having to wait for him to send me the money for Materia, total around a week delayed. My fiancé ended our engagement in Christmas Eve. We bought in his name only in 2017- I found the home and negotiated a price lower than asking 290. I also then arranged for a 203k loan and dealt with all the inspectors through the process. I designed the changes to the home, I researched and found the materials at cost prices due to my background in construction. I used a cousin for the contractor I have thousands of research and sweat hours into the home.I paid for tens of thousands of fees out of my pocket and gave him 20k to put in tve bank in order to get a personal loan to pay off his credit cards. It was always our intent to flip the house when the time was right. The house last appraised for 557k and my guess it is now more like 679k I’m still in shock of the broken engagement as he’s using issues well before he proposed. I know he’s in a depression and dealing with ptsd due to an ongoing custody battle. But I need to protect my interests. I was in the hospital with COVID breakthrough and in a coma for three months I had a flood in my home and the contracted midigation company sent me a notice of Lein and I didn’t get it till just now. I’ve tried reaching out. No resolve. But because they are charging more than my insurance is allowing to pays. I don’t feel responsible for that. They left equipment four humidifiers and normally each one is a charged for three days. They finished the clean dropped them off and I told them to come get them. They didn’t They also said don’t worry about it. Get well. Then I was waiting for clearance. This was at a time I was sick and required surgery they never got them. Then I caught Covid and was in a coma for three months. I come home to this. I don’t want to lose my home. Ans I have the allowed money from the insurance but I can’t pay them anymore than what’s allowed and agreed. I also caught leukemia July 2019 and I told these guys I was in no rush. I can’t take the stress I’m going to die and so is my 78 year old mother who lives with me.I like to dot my eyes and cross my tees. They gave me no time to get documents together. I made the final payment to the contractor in August. During the walk through there were many things wrong, He wrote me a check for $2000 until it was completed. It has never been completed after 6 months, so I paid to have the work done. I let him know the expenses and he threatened to put a lien on my house for the $2000.00. Does he have a leg to stand on? I am a single mom. I hired an electrician to do some repairs and install some fixtures at my newly purchased economy house. The total work would have taken about 25 hours. He came a worked a couple hours, disappeared for weeks, came back and worked another couple hours, disappeared, etc. He put a supplemental circuit box in my kitchen and mis-measured it so it is too low for the cabinet that goes there, so it has to be re-positioned. He put some conduit for an outside entry light at my front door, but it came loose and presented an electrical hazard for my children so I had to get someone else to remove it. Over a 3 month period, he worked 15 hours in 2 -3 hour widespread increments. The last time I saw him, he indicated he would be back. Instead, he sent me an invoice for 17 hours (1 hr of which was his mis-adding) and a whopping $577 for "materials" which were not itemized. I had furnished all the fixtures and most of the outlets, boxes, etc. The circuit box he installed in the kitchen was $36.94 retail with 4 breakers totaling under $40. That leaves $500 of materials unaccounted for. I paid 75% of his bloated invoice with a note that I would pay the rest when he finished the work, fixed his mistakes, and provided an itemized list of materials. Today he sent a text saying if I did not immediately pay the remaining $577 of his invoice he would put a lien on my house! This is crazy! I've been patiently waiting for him to come back to finish. I'm the one who has the legitimate complaint! I expected quality workmanship done in a timely manner and I got neither. I am now left having to hire someone to correct his errors and finish the job he started. I do not want him to put a lien on my property for the disputed balance of his invoice, nor do I want to pay him money that I question is legitimate. What should I do? ...Read More
