We have filed a lien but contractor is holding final payment, we wish to file lawsuit and looking for an attorney.
GeorgiaI am a small-time, independent contractor. I was hired by a property manager to renovate a duplex unit. I paid for materials myself and have many hours invested in the work. It’s been over 2 months and he hasn’t paid. The amount due is only about $575, but that amount makes a huge difference in being able to continue my business. Would a lien even be worth it or is there anything I can do?
MissouriIn the case of a homeowner's association, what are the options for filing a lien for unpaid assessments and/or fines for non compliance with covenants? Is this a statutory lien?
WashingtonHi I am a handyman and a tenant of this property owner. I have done numerous amounts of repairs at the property I currently live in. At this property there is what is called a Florida room, which is basically a enclosed porch. This enclosed porch was in very bad shape from the day I moved in and continued to get worse. It was badly weathered and had very bad termite damage. I complained to the landlord about fixing it. She finally got around to trying to get it repaired. She found a contractor of some sort who started the job, he torn down a few drywall pieces from ceiling and removed the door. The gentleman never returned after the first day. He actually never returned at all. I spoke with my landlord about the situation and she says he ran off with her money she gave home for materials. Now at this point this Florida room definitely needs some attention, because the drywall was torn out and out door is missing. So she finds another gentleman to carry out the job. The gentleman who she hired was a alcoholic and very uncomfortable to be around my home where my wife and daughter live. I tell her my concerns and she stops him from working. I’m a handyman and I’m well aware and capable of doing the job myself but at the time I was very busy with my own work and couldn’t do the job. A few days go by and I’m tired of seeing our home like this and I tell her I can finish the job. I write out a estimate for her explaining exactly what I was going to do to make it back right and be livable. I included all the materials I needed. My estimate amounted to $3000 + materials. She agreed and I also made payment arrangements with her. $500 was to be deducted from our monthly rent for 5 months until the $3000 was satisfied. She agreed, I begin work I’m March 2020 until sometime in June or July. That’s when she received a notice from the city, that the work that was being done was in violation. The violation was that there were no permits for the replacement of windows and doors. She had to get the permits or there were gonna be fines applied to her. At this point I’m about 90-95% completed but she tells me to stop working, until she figures out what to do. So after about a month she tells me she has been back and fourth with the city and has found a contractor that is willing to pull the necessary permits needed and be a liaison to the city inspector. She sends the contractor over to look at what’s been done to go get the permit. The contractor gets the permit and schedules the inspector to inspect the work. The inspector signs off on the job and now she has satisfied the city and violation case is closed. I start a conversation with her about our agreement regarding payment since I’m close to final completion and she tells me I have a remaining balance of $1200, because she has deducted the amount of money she paid to the contractor from the money she is owed to me. We have a heated conversation about how I didn’t agree nor do I understand why she would do that. She was not trying to hear anything I had to say and insisted on that is what she now owes me. This situation has hurt me financially and has caused my family to be late on rent. Once we were late on rent and tried to get rental assistance she consistently tried to scare us with eviction and she has actually filed for eviction with us. It’s been a real headache with her at this point and I do t know what to do about getting paid for this job or what can I do about getting paid. Can someone share some advice. I’m thinking about filing a mechanics lien but I need more information about it and how to go about filing it.

IndianaAs an architect we worked with a client to design there project and end the project design entitled in Sunnyvale Ca. The client loves the design and the project is approved through the city. They have paid 85% of there bill however have not made a payment in 9 months now. Last week we found out they are trying to sell the land with the approved design plan. They tell us we will get paid as soon as they sell the parcel. We are concerned that once they sell the land they will dissolve the LLC and and we will not see the balance of the contract. Is it to late to put a lien on the parcel?
CaliforniaWe are a general for work in the state of Washington. The Model Disclosure Statement was not filed and now we are wanting to understand if filing a lien is still an option available to us (Based on the Last Date Worked - we have approx one month before we need to file (if we can)
WashingtonI'm a license residential general contractor in Louisiana. My client refuse to sign my contract because he wanted to add items that were not estimated in my total cost. However, The owners gave me permission to start the demolition which I did and during that period I sent two invoices for payment which they paid. I informed them I needed to get a permit on file for the project, they wouldn't sign my contract, during the demolition we came across termite damages. I repaired the termite damages, when I refused to include items to the contract, the owner decided to terminate my services.
I sent an invoice to the owner for termite repairs, he refused to pay.
LouisianaHello, I am a property owner in South Dakota. It has been 9 months since I paid a 50 % down payment to the general contractor to get a bedroom/ bathroom remodel done. The first crew of subcontractors walked off the job in October 2021 after multiple delays, disputes and stoppages. The GC hired a second subcontractor crew to complete the job. I paid an additional 25% to GC at that time. Today, March 2022 there is still final finish work, some electrical and light installations and all of the plumbing fixtures to be installed. Today the replacement subcontractor informs me he has not been paid for several weeks of work by the GC and is filing a lien against my property. What are your recommended next steps? Thank you.
South DakotaWe are the General for work in the state of California. We did not file the notice at the beginning of the job. Would our lien rights still be availanble to us now?
CaliforniaI'm the direct general contractor working on a residential project in CA and did not file the Preliminary Notice within 20 days of starting the job. I've been off the job but I'm still within my 60 days of having been on the job but I'm not receiving payment. Can I now file a lien? What if any are my legal options?
CaliforniaThe owner choose to not pay and to continue with a different company after he changed the original agreement/contract to the point that the contractor (myself) could not finish the job that was agreed upon. While they are trying to sell the property that our contract and work pertains to.
TexasCompleted work months ago, client is stating ownership hasn't paid GC and therefore is withholding payment. Currently are holding contract work and Retainage money.
ArizonaWe have a full lien placed on a property we did work at and the homeowner has since pasted away. The property is being sold and I am being asked to provide a written pay off demand letter with a date good through. Is this something I just write up myself?
NevadaI’m a handyman who took on our back patio after guy our landlord hired started but left our back patio wide open and never returned. She was to pay me $3000. The city contacted her mid project advising about non license work and no permits being requested for work here. She now says no payment because she had to pay city fees that were doubled due to not having proper permits.
