I am worried a contractor may try and place a mechanics lien on my converted school bus. There was never a written or signed bid/contract and they are saying I owe them the final payment of $1500 even though I do not believe the agreed upon work was completed. On January 17, 2022 we had a meeting and I sent a text outlining what I believed was agreed upon. That was ignored until January 27, 2022 and was subsequently verbally amended and that work also hasn’t been completed to what was agreed upon or expected. We are currently about to file a lawsuit with the contractor on this property. Our attorneys have been going back and forth. My question is can I only file lien for december work billed 1/6/2022 in which both a notice and lien intent were sent on 3/4/2022. or for total up until march? Also, we recieved a termination of project letter on 3/4/2022 from contractor. Can we also file lien on the 10% retainage at this point. It looks like texas has a Notice of contractual retainage that needs to be filed as well. Please advise. We need to make sure we get this right. They owe us around $450,000 total and we dont want to give them any outs to pay us....Read More

We were hired to complete a radon project at a private residence where a deposit was collected and labor, parts and materials were scheduled and purchased. Upon showing up to the property, we discovered the information we were given multiple times by the owner was grossly incorrect. As a result, we were unable to complete the the project to the original scope and plan that day and a further assessment and further expert advice was given to the owner at the property. The owner and our company agreed to expand the project to meet the owner's requirements and a follow up quote and proposal was provided. Our technician was on site for 1.5 hrs and over an hour of travel time was required to get to and from the site. The home owner then decided to hire a non-radon certified professional (a plumber) and decided to not use our services going forward. We are now requesting that they pay the now overdue remaining balance for the original project we were hired to do which they have refused to pay. Are terms our clear that the the remaining invoice is to be paid on the day of the installation and we only agreed not to collect on on the day given we would expand the project. I am now going to retroactively apply late fees, accrued interest, etc. per our terms but I need to know if I add this to the final amount we will be seeking in a lien? I also need to know if I apply the fees to file such a lien if needed and service fees from Levelset in the lien amount? Or do I add these later if a lien is required to filed? I'm a digital markteting contractor who was hired by a sporting and events facility to broadcast live games and improve online traffic. I rigged up a 100 yd. cable that was anchored into the concrete wall to run a trolly cam also known as a condor cam. My agreement was to receive a base salary plus 10% of new revenue growth. All three of the building's leadership and management team were on the call when that agreement was made. I took the job on speculation knowing that they hadn't had good marketing advise in the past and I was confident in my abilities to double traffic. Traffic improved 129% and now they don't want to pay me the 10%. Can I file a mechanics lean just for the tension cable or can I include the whole amount?...Read More

RE: for our front landscape. from Las Vegas, Nevada No written contract was given for the services to be rendered. My wife and I simply wanted someone to check the new plants and one tree that was planted in November of 2021. We also wanted someone who would check the water drippers to make sure they were functioning properly. We found someone and explained what we wanted. Important: my wife always asked the service to call or text before they came so that we would be able to discuss what was needed. When a time and date was established they came one week earlier without notifying us. They did not check the plants. They did not check the drippers. They merely blew the leaves away. The owner did not show up for the job. he had two of his employees do the blowing of the leaves which took less than 20 minutes to do. When the owner took the job initially he promised that he would always be there to check and discuss the condition of the plants, tree, and drippers. In summary: 1. Owner did not show as promised! 2. plants and tree not inspected! 3. drippers not inspected for possible leaks and positioning! 4. no call or text for service as agreed upon! Showed up several days before possible service. 5. We had a right to cancel if a date for service had been agreed upon. 6. Owner said he texted the wrong customer instead of my wife. 7. Two men showed up unexpectedly and my wife did not know they were here....... Owner threatened us with a lien and collection for $60.00 if we id noy pay within 30 days.
