What can a homeowner do when a contractor lies about being a certified installer of fiber cement board siding and did such a poor job the manufacturer states the poor installation voids the 30-year warranty? We also ask for a particular siding manufacturer, and without talking with us he decided to go with a different manufacturer, even though the manufacturer we requested was written into the contract. The same contractor hired a painting company and their work was so poor the paint manufacturer also will not grant us the warranty. In both cases, the contractor only warranties his work for a year. He also refuses to correct any problems because in his opinion he did the jobs correctly. He also tried to write a new contract and gave us only 48 hours to make our decision. Now understand this was different from the contract we signed for the bank construction loan. Please help us understand if we have any rights against the contractor. ...Read More

Hello I worked on a construction project and the final payment was never remitted. it is 25 thousand and now over 40K with interest charges. Customer owner/was also the GC in the building -I provided door access and thermal monitors. The system has been running since 2018, when I went back to receive my final payment from finalizing the "punch list". I placed written final demand and The General attorney for the firm agreed I will be paid after the ;ist. When I arrived on site, there was a new General attorney and no one to pay me. The new Attorney made me go over all details again, said there was yet another punch list, agreed to my payment and then left. Why> Both attorneys were also Never Paid. Good morning, I'm not sure if I can ask this question here. If not, can you let me know who I can ask this to? We're a scaffolding company in California and we're trying to see if we can file mechanic's lien but the property owner's attorney is saying that we can't file lien due to the following situation: our subcontractor work was done on a cell tower (not a real property) for a GC who was hired by AT&T who is a lessee/tenant for a property owner. Property owner is saying that we can't file lien against their property as we didn't perform work "at the request of the owner or the owner's agent for constructing a work of improvement on real property." Dear Levelset Advisor: I have utilized your "notice of intent to lien" letter recently for a delinquent in payment client. I did not do any type of construction work at this client's home. What I do is appraise personal property to be sold, plus organize and conduct estate sales that are situated in clients' homes. This particular client chose to cancel her estate sale at the very last minute. My staff and I had already staged her home for the estate sale, displayed all of the household items that were being sold, researched resale market values and priced household merchandise, advertised the estate sale in several media venues, identified the fine jewelry to be sold and arranged for diamond rings to be appraised. The contractual agreement indicates that if the client cancels the sale, he/she are responsible to pay for services conducted and the amount is indicated in the contract. The client engaged my company on July 3, 2019 and then canceled the estate sale on July 30, 2019. I was notified by her son to send him the invoice, which I sent shortly thereafter. No payment was received. After a couple of weeks, I called and left a message, there was no response. Two weeks ago I sent another invoice with a friendly letter, again no response. I asked a similar question earlier, but I don't think my question was very clear. We are an aggregate and ready mix supplier. A customer placed an order with us but provided the wrong address. We delivered to one address (the actual property that received and used the material) then sent a preliminary for a different address. The properties are very close. We believe the customer did this to prevent us from properly establishing lien rights. It does not appear the customer owns the correct property, but is the general contractor.
