I have a mechanics lien on a residential property in AZ. The home owner has told me that he no longer owes me because he filed bankruptcy. I have never gotten any notice from the courts saying my contract was part of a bankruptcy proceeding and that it is no longer enforceable. Could it be true? Or is he lying, or trying to get me to let my lien expire so he won't have to pay?...Read More

We are 95% finished with a job and things became contentious after we asked for 20k and the remaining upon finishing the job. Which amounted to aprox $3500 they gave is 10k then wrote a check for another 10k and canceled the check the next day. We said that was fine if we sever this relationship, you still need to pay us for the work completed minus the last few items on the job and you can find another contractor to finish. They do not believe that they have to pay for the work completed, only the finished product....Read More

I did work on 2 seperate houses and it was 2 seperate homeowners. They both refused to pay me what was due in the end. 1 homeowner lied to me and asked me to return materials so that they can hire another contractor and I would get paid a certain amount upon delivering materials. Once I get there they try to lowball me etc etc. 2nd homeowner was indecisive and wouldn’t listen to my recommendations and in the process of her stubbornness things got damaged during transport and I warned her about that. In the end she wanted me to redo everything for free and didn’t want to pay me....Read More

I'm a general contractor, And I was hired by a house flipper who specifically knew that I'm a one guy operated business, and he still decided to hire me, so when I 1st gave him the quote for the big exterior job the price was for $17,000 which labor and materials where included for the set price of $17,000 so long story short is he wanted me to do some interior work also so I gave him a extra bid for $7,000 for interior work. So I give him all my business information and same with my father in law because he said he needed to purchase permits for the windows, siding, and interior work that I did. So I made two different contracts which he never signed , but agreed inperson. I had the msgs but than my phone broke and I lost them. But anyways I bought the materials for the exterior siding install , housewrap, window flashing, metal drip edge , brand new trim , paint , caulking , coil nails and the list going on... so I finished more than 85% of the job and he started to complain that I was taking to longer /if u could please give me a call at 2532080929 please id appreciate it ...Read More

I had a falling out with the contractor I hired to build the ADU and am wondering if he files a lien and subsequent foreclosure action, how that effects my daughter's interest in the property. Do the lien notice and foreclosure action need to be served on both of us individually? ...Read More

The situation: A hard money lender is financing a residential fix and flip project in the state of Massachusetts, and a mechanics lien was filed correctly with preliminary notice and intent. Lumber has been supplied to the borrower on the project, and the lumber supplier has not yet been paid for the materials supplied to the location. Is the supplier protected to recoup the value of the materials on the project location? If so, what events are possible to occur where the lumber supplier could not be repaid back by either the lender or borrower?...Read More

We had a contractor replace the tiles on our front porch. We paid for the materials up front. The contractor sent some guys to install the tile. They were very rushed as they were leaving for a job in another state the next day. We met with the contractor to go over the problems with the job. We were assured the problems would be addressed. The guys came back one more time and attempted to fix some of the problems, but many remain, including major issues with the grout and trim. The contractor promised to come back on specific dates to complete what he referred to as a "punch list" but never showed. Now he is demanding payment. We had agreed to put the money in an escrow account with a lawyer to be released upon completion of the work but he is no longer communicating with us and just informed us he is filing a mechanics lien. We would like to get the work completed and have no plans to sell the house anytime soon. What are our options? ...Read More
