Customer brought the car in for repair. Customer made aware of diagnostic fee and signed initial contract. After finding out the cost of the repair ie replacing the transmission customer could not afford repair. Numerous attempts to contact customer have been to no avail. Contacted the finance company who has a current lien. Finance company initially was in favor of repair. Finance company came back to say they would not pay for repair due to the age and value of the vehicle. I informed them of the impending fees I.e diagnostic fee and storage fees as the vehicle is still on the premises and mounting daily. Currently no repairs have been made just diagnostic and storage fees. Finance company refuses to pay those fees. Still no contact from the owner....Read More

Hello. I had a contractor file a lien for work was not performed. In addition removed material off my property. I was forced to finalize the remaining work on my own. My question is the theft of materials considered conversion? As well, I have a detailed accounting of materials removed, work performed that contractor did not finish. To date, a lien was filed for $53,000 with no lawsuit. The frivolous lien was filed with a round number but not any invoices or any detailed accounting We have a thorough narrative and proof of work completed. How can someone perfect a lien in Montana without supporting accounting? In addition we are a brand new RV park with lost income due to the contractors dishonesty, and delay in opening. We have made continuous requests-demands for an accounting. Can someone just make up a false lien and file it with no accounting? Any advice would be much appreciated, In addition to a SW Montana attorney that specializes Mechanic Lien law-consruction litigation? Thank you for your time in advance. Matthew. Hello. My neighbor has performed many plumbing jobs for me. I hired him to plumb some fixtures and let him know that I would be providing the materials needed, which also included instructions for proper installation of the fixtures. He chose to use his own materials, ignore the instructions, and in doing so, rendered some of the functionality of the restroom unusable. I have since paid him, but tried to negotiate a refund for the improperly performed labor, or a fix at a discounted labor rate. He agreed to neither options. I have considered disputing the charge on my credit card, but he has since threatened to file a mechanic's lien against me. Does he have legal grounds to do so if he performed the work improperly and I dispute the charge? Thank you...Read More

I am a house owner in Pennsylvania. I had hired a PA to help with an electrical unit replacement claim. The PA then called the restoration company to rip off the drywall and install moisture sucking machine to find the potential leak that caused the unit replacement. They were unsuccessful in finding the cause and then we got a local handyman to fix it for us for just $150. We were told that that the claim would pay for all the expenses but the work authorization contract we signed with the restoration company had a line that said I will be responsible to pay the company if the claim gets rejected. The PA also created an inflated bill for future repairs such as repainting the drywall and carpet replacement and sent it to our insurance company which eventually got denied. The restoration company wants us to pay the inflated bill of $8000 for one day's worth of work (ripping drywall (in ~100sqft area) and sent us a notice of lien. How do I deal with this? I do not want to get into any legal battles....Read More
