We agreed with the customer finish and done touch up and fix all ceiling garages area, walls, and ceilings in dining area, all corridors and one ceiling of one bedroom since was damaged for water leaks in the storm. We done all of these and we paint the ceiling and walls they looks like new. Then we requested money to the home owner for progress and she reject our 50% money request saying that we have things left to do and somethin that is true, we still have to go back and install one toilet, one bath exhaust fan and few ceiling round trims . other than that everything per scope is done. She just start arguing with us and she refuse to pay the invoice and now she say "you dont what to much headaches, i dont want to rest done and i will pay you this amount" this doesnt work like this, the customer can't cut the price in invoices or estimates, she can pay wherever she wants. the price is the price upon she agreed with. Im trying to force her to let us get into and finish tis little things cause is only one day left of work and she still have $5,000 in her hands that she dont want to pay. what i should do with this?...Read More

We are flooring company. We filed a lien against a homeowner. The homeowner is claiming the lien in invalid and threatening lawsuit against the company as well as me personally if we don't remove it. These are the specific questions: 1) If a preliminary lien notice was sent a week after the mechanics lien was filed, does it invalidate the lien? 2) If our contractors license was not valid at the time the lien was filed, does that invalidate the lien? The contractors license was valid at the time of material purchase and when the verbal contract for installation services was agreed to. Our contractors license had not been renewed on the dates the work was performed. We hired an independent contractor to install material, who is also a licensed contractor. I own a company that has a construction business license through the county. Im not a Gc . The company is a cleaning company originally. I was asked by a client if we could do some repairs to her home and i explained that it would be possible because my husband is a handyman .So repairs were done and the last bit was completed. She refused to pay and said we couldnt put a mechanic lien because im not licensed through home builders. So my question is now we will be going to court and her lawyer is stating i cant collect what is owed because of improper licensing. But the big thing is she knew what my company was never mislead her one bit . Everything we did fell under what a handyman is allowed to do. So here we are 6 months later and she admitted she owes the money but is refusing so now she is attempting to sue me ....Read More

I was in a long term relationship and lived with my boyfriend in his condo in AZ. We made a number of substantial improvements over the past 2 years to include a bath upgrade, a new AC unit and flooring. The plan was for him to put me on the deed, or sell the property and purchase a jointly owned property. Before he filed any paperwork, he died of Covid. Lien was filed and served regular mail. Affirmation of service was timely served. Then, I followed with RRR service, but didn't file an affirmation on that service. And it was a few days late. Are there any defenses that can save my lien? Does the owner have to bring an action to discharge the lien? And then can I defend this? I know it sounds like a total nightmare. I'm a home owner and the contractor filed a false mechanic's lien on my property in California after abandoning the job without legal excuse according to the California Contractor's License Board who issued a citation to him saying he has to pay me money that exceeds the amount of the lien plus $5,000. in civil penalties. Among other contract violations, he never gave notice of a mechanics lien. I wonder if this makes his lien invalid and if the lien could be removed based on this in a motion to expunge. I also wonder if since he also included my parents in the lien and lawsuit because they're on the title of the house, even though they were not on the contract, did he need to serve them a preliminary notice (which he did not). If so, does that invalidate the entire lien or does it just remove them from the lien but not me?...Read More

(Using false names for privacy). I hired ABC company to do work on a rental property. John Doe wrote the contract, signed the contract, received payments, and did some of the work. Jim Smith has a truck with 'ABC company' written on it but was never apart of contract negotiations. Whenever I had an issue with the work, I would go to John Doe to address but he would blame it on Jim Smith and refuse to take accountability for the quality of the work. There is a line in the contract which states "final payment shall be withheld until contractor signs final lien waiver". When I presented the lien waiver to John Doe, he refused to sign bc he had not received full payment. At the same time, I asked for a w9 for tax reporting and that's when i realized that ABC company is not a real company (not registered anywhere). Also, Jim Smith claimed that he had not been paid and John Doe was not honest about the full contract amount. Because we learned that Jim Smith had not been paid, we decided that we definitely wanted to have the lien waiver in hand prior to making final payment. Since the contract ended in Nov 2020, they have been going back and forth with each other about who should get paid what. Fast forward to today, I received a letter with a claim of lien. Looking for an attorney's advice on this. Who should I pay? Who would sign the lien waiver and should I wait for that first? how do I contest the lien? Does his poor work factor into the amount owed at all? (Small example; he was paid to install kitchen countertops---2 months later, i discovered the countertops were not secure on the cabinets. I had a house renovated in NY state. General contractor was hired with a fixed price for the work. Unbeknownst to me, he subcontracted the work out. GC didn't fully pay the subcontractor. Sub Contractor has now put a mechanic's lien on my property and is charging me by the hour and it is more than the price that I contracted for originally. I'm in no hurry to sell. There is no equity in the house between the first mtg. and another lien already placed on the house so I don't think they will foreclose. My supply house is placing liens on my projects that I have been paying him on. I have not missed a month even with Covid. I have made payments of 10k if not more. But it is still not enough for him. He wants more money due to the outstanding balance of 200k. He just placed another lien on a job when I made payments and he cashed 2 weeks before. It feels more like extortion. I understand his frustration, I have proof of all payments and emails as well asking him to not do this since I am making payment. What do I do.? Hi. Property in NY. We hired a contractor after we had a fire. Unbeknownst to us, the contractor hired a subcontractor. Subcontractor was not fully paid by the general contractor. Sub has placed a mechanics lien on the property for more than we hired the contractor for. We are in no hurry to sell the property. It is my understanding that if we do nothing, and the sub doesn't ask for an extension to collect, and doesn't attempt to foreclose, that the lien will expire at some point. I have a roofing project that i am working on in Oregon which has a roofing consultant acting as the owners architect. We have completed the work but the consultant has rejected some of the installed work. We are attempting to negotiate with the consultant / owner, but it has been 63 days since we were on the job and a lien must be filed at 75 days, and there has been NO Notice of Completion filed on this project. My question is regarding the word "completion". Does completion mean "substantial completion"? Does it mean when we tell the customer the job is finished and send final billing? Is the date of "completion" extended if there is a punch list and work is performed after "substantial completion" of the job? If the punch list is in dispute, and or the owner or owner's architect / consultant has rejected the work and is asking for additional work, is the project considered "completed" even if the punch list work is not yet completed? In the above scenario, is owner's acceptance required for "completion" to be achieved?
