I run my sole proprietership business in ny. I did a job just over the border in pa. I never got a down payment as i guess i am too trustworthy. All there was was an oral contract. i worked for almost 3 months on the job and the decided they didnt want me to finish. I have maybe a day of work left to do. I am to believe this was an excuse not to pay me. I did not realize in pa i had to register with the attorney generals office. If i were to file a mechanics lien what are my consequences. I'm a General Contractor who has completed a project roughly a year a go in McKinney, TX. There were 2 agreements that were executed for this project: Contract amount on the AIA 101, and a separate Funds Control fee separate from the AIA101. The Contract amount has been paid off after completion, however, a separate Funds Control agreement that was also executed amongst us (GC) and the client hasn't been honored. I was interested in filing a Mechanic's Lien for this case on nonpayment for "Labor" regarding funds management on the project. However, it doesn't necessarily pertain to the contract amount. Would filing the Mechanic's Lien be appropriate for this type of case on nonpayment from client? ...Read More

250 LF of fencing replaced & stained at a condo complex in Dallas Texas. Work was completed Dec. 23rd. We requested payment to close out our invoice & they stated they needed time (Until Jan 7th) so their Maintenance Manager could return from vacation to do a final inspection and let us know if there were any punch list items. During this time we sent an Intent to File a Lien through Levelset. We received a punch list in the mail January 16th. We reached out to say we would respond to the punch list but we needed some time to complete a separate project we had previously committed ourselves to begin & complete according to a strict deadline. We are a small business with limited man power so work was not able to resume at this property until we completed our other project. We had some setbacks & then experienced weather set backs. Now we have received a letter terminating our contract & an estimate from a different contractor to complete the punch list that was sent to us. Our total labor cost to do the whole project invoiced was $4500. The new contractors estimate to complete our punch list was sent as $6525.00 The property management is requesting for us to pay them the difference of $2025.00 to get the punch list completed by this other contractor. Can we place a lien on this property? Is there any way to ensure we can complete our punchlist & get paid for all the work completed? ...Read More

My boyfriend was putting in a new motor in his chevy since he didn't have all the money he needed i was able and willing to help him out..i bought parts and fluids for it with tbe agreement he would pay me back..before he could get it put back together he went to jail leaving it in my friend which was kind enough to allow us to use his garage for 3days which has now been allmost 2 weeks..any how...i im left to get the truck back together i end up hiring someone to finish the job but by this time the now ex and i are not speaking due to unrelated issues ..he get a chance to talk to me and says he doesnt think hes going to let me use the truck now..ive allready spent 1600.00 on gettin it running and now he will not pay me back or allow me to use it .how can i get my money back now that i have found out he didnt even bother to put in his name when he bought it...Read More

I was subcontracted by a company to do a roof. I finished the job, sent an invoice and was not paid. He cut all contact with me and blocked me on all levels. So I filed a intent to lien, then my mechanical lien. It was sent to the courthouse and filed. Now the homeowner had a lawyer threaten to file suit against me for slander of title if I dont take the lien off. He said I never filed 779.02 first. I am new to all of this and he said in Wisconsin you have to. Am I up the river without a paddle or do I have a foot to stand on. The homeowner did pay the company but that company has not paid me a dime. I provided all materials and labor. I know, shame on me for not collecting a down payment. I would like to know if I have grounds to file a lien... A local small time general contractor asked me to do a job on short notice the following day. He said he was scheduled to do the install but his team got Covid. So, we did a $2800 job (with contract to him) the next day, Friday Jan 29th. It was such short notice, but I did not have time to collect a deposit. Once complete, he wrote a check (from a Walmart MoneyCard account) that bounced. So, since we have finished the job it has been one excuse after another on why he can’t pay me. Today I went back to visit the homeowner of the house to see if the money they paid him to do the job could be canceled to pay me instead. I found out that he is indebted to them (homeowners) for over a year to do work for them in their backyard, plus they gave him a $5k loan for some reason. He told them he will do their garage for free in order to pay them back some of the money. So, he never intended on paying me anything in the first place.
