Cabinet refinisher in Springfield Illinois. Started complaining about it's not showing up. The job consists of two bathroom vanities what laundry room vanity and kitchen cabinets. The only thing we have left there in the house is the kitchen cabinet frame all the doors and drawer fronts have been sprayed in my shop at a remote location. The customer doesn't get to witness the work we put in at the shop. My contract clearly states that there is no given sight time or shot time it varies for each job and we will not be held accountable for an 8 hour day in the home. My contract also talks about estimated time of completion may go longer and term of this agreement may be extended without consent of both parties. Also ...contract states that if client interrupts our services and doesn't allow us to complete....that they are still liable for remainder of the amount of the contract. In this case its approx 1650. She showed up today beating on our shop doors and windows demanding we give her back her cabinet doors and drawer fronts. I told her no. She said then I'll call the cops...I ssif go ahead I have your agreement and permissive signature right here alone GB me to my work and finish my work. 1. Can she have me arrested? 2. Can I place lein on either cabinets, her house, or both? 3. Can I go after full amount if I give her the stuff back unfinished....Read More

I am licensed to do Home Improvements in NY, but I have a problem with a client that signed a Home Staging contract with me and did not pay rent on the furniture for over 6 months and his property is about to close sales. We have supplied material to the general contractor on a public county project located in New Jersey, final delivery date of 01-21-2021. According to our Levelset guidelines we are due file a municipal mechanics lien in 7 days, the is same date that our final payment from the general contractor is due. All of the material we have supplied has yet to be installed, and therefore, has not been officially accepted by the public entity. Will we still have lien rights if we file later than the due date suggested by Levelset? The homeowner is refusing to pay what is owed for work done on his property. We are a sub contractor & are paid by the GC who actually has the contract with the owner. Monies are owed to multiples subcontractors as well as the GC. I am a GC. Builder refused to pay me so I can pay my sub. Builder refused to pay because someone damaged a fireplace flute but she could of used my liability insurance to fix? Both sub and I have filed mechanics lien on property. Builder and sub exchanged messages and builder kept telling sub to wait and then refused payment. I am at loss on what to do. I am a subcontractor seeking payment for a job that was performed by construction plans and methods for an owner/GC. However, I hired a company that was working as my subcontractor and ended up firing them from the job due to lack of performance. They contacted the owner with a debt collector agency. I am a General Contrator in New Jersey. I have a residential client that is currently engaged in a contract with me to build their house. I have received a deposit along with the first contractual payment. They have in formed me that they only have enough money secured to make the next two contractual payments leaving a shortage of approximately $265,000.00. They are in the process of attempting to get funding but there is nothing set in place as of yet. After the next two payments are made the project will have to come to a halt until funds are secured. I am not sure what the next step should be. What if they can't secure funding at all? My concern is that they entered in to a contract without having proper funding. Because the delay of the contractor the city found another contractor to finish the repair work. We filed a court case to sue the contractor for the damage he caused by the bad job he did. Clarification please re: Mechanics/Construction Lien. State of WA states for repair, remodel or alteration of owner-occupied principal residence, a subcontractor can only claim that portion of the contract price not yet paid to the prime contractor even though the contractor did not pay the sub. I hired a roofing contractor last summer to replace my roof and gutter system. They completed the "contractual" work on 10/21/2020 but there was damage done to the materials around the dormers (fascia, trim, siding, etc.). The company sent people out to do the repairs in January of this year but there's still damage that wasn't addressed. I withheld final payment around $4,900 until the damage is repaired. My question for you is regarding the 120 days. Is it 120 days from the last date of "contractual" work or is it 120 days within the last time they were onsite to do some of the repairs? The owner has been extremely aggressive and threatened to put a lien on my property unless I pay. I do not feel comfortable having them back on my property and prefer to hire another company to make the repairs. What legal standing do I have? Is it too late for them to file a lien?...Read More
