As an unpaid employee, can I place the lien for unpaid wages without any other notices to owner etc?
I am an employee/laborer and unpaid by a contractor for work performed on several houses in FL. I understand can file a lien and do not need to pre-lien or notice of intent to lien or give notice directly to the property owner as I am not a contractor, but am an unpaid employee of the contractor. Is this correct?
Also, one of the properties sold and closed in only a few days from completion, I plan on placing alien against that property as I am unpaid for labor there as well.
I have given notarized notice to contractor of unpaid wages and listed properties and values for each property that is unpaid. As of tomorrow night they will have no further right to address or challenge any of the amounts. The contractor attempted to pay me less than owed with a memo notation "payment to be caught up, paid in full" I have not cashed the check.
FloridaI'm a GC working on a residential home remodel. We had an initial contract that the homeowner signed and has made partial payment on. Since we started working, there were added jobs the homeowner asked us to do. We got approval for everything but mostly on the phone. We never did any work without the homeowner's approval and most of the time we were able to give them a quote for how much the added job would cost. They suddenly took an issue with some of the added job amounts and told us to stop working. Most of the jobs were either complete or mostly complete. Now they want to pay us half of what we're owed and this includes not paying us for unfinished jobs (which are mostly done but we had to stop when the homeowner asked us to). We sent an email containing a total amount owed and the homeowner said they'll leave everything up to the mediator. I'm not sure what that even means. I work hard and have never had a homeowner do this. I understand I'd have to prepare a lein and file it with the county. Just want to make sure I'm not missing anything. My partner and I did most of the work but we had a subcontractor do some electrical work. Would I only list the electrical sub in the sworn statement or should I also include all the work we/GC did? And assuming we get a lein, what's next?
MichiganIt’s a project that belong to a family member, that has been promising to get us paid every week & begs us not to put a lien on his property. SHows us that the money is coming in but we never received anything. Now his house is in question if he keeps it or not. He has a lawyer, I they have put money aside to cover morales & extras. We want to be included.
CaliforniaWe filed a Mechanics Lien on one of our projects in June 2020. We did not received a notification about the extension. As the year ended we are going back through all of our jobs and noticed that the extension was not filed. We are currently in contact with the GC about getting payment. But I wanted to check in to see if that does not work out what are our next steps to get this payment protected, lien extended.

There is still work from scope that needs to be completed as well.
When filing a mechanics lien do I include the extra work amount and the amount for the incomplete scope plus retention amount?
CaliforniaI'm a general contractor that finished a job in January at a hotel in Palm Springs, I never got paid. How does filing a lien mean that I will get paid? I don't understand how it works.
CaliforniaI am a general contractor in the state of Louisiana. We have a contract for a reroof, gutter, soffit and fascia. We have only completed the reroof portion no other work as the homeowner has ceased to correspond or pay us for the work competed. We didn't file a Notice of Commencement but have a contract and have sent in the invoice to insurance and have confirmation from insurance the homeowner has been paid. Please advise as to if we have lien rights? We sent the notice of intent to lien through level set on 3/13/21
LouisianaI’m actually a repo man here in Houston and I have a mechanic shop telling me that under Texas law 70.001 I’m legally allowed to repossess a vehicle if payment was stopped on a check. I typically work for car lots so this is a new one for me. Does this mechanic shop need to apply for a mechanics lien before I pick up this truck?
TexasIf an apartment flooded and the maintenance guys just put fans on top of carpet without removing water. I received call from tenants mother they needed help. I went and removed water, carpet and padding as the water was grey water. A toilet over flowed from wipes being flushed from someone in the complex. The tenants property was getting damaged from sitting in water. Tenant from across the way cane out and asked what I was doing. I told her and she took me into her apartment. It smelt like throw up and mold combined. I asked if maintenance came and they just put fans. I was upset because she had children sleeping in there. When removing carpet I found mold. It seems like this complex ignores issues and just puts fresh paint and ignores it.
TexasI am a licensed Construction Superintendent doing Safety inspections on job sites. I visit each job that I have signed a PW2 ( allows client to get a work permit. ) Five days a week I visit the job site and write a report that is then put in the job site log to verify I had been there . If the NYC DOB
stops by they want to see the log and that it has been kept up. I receive a monthly fee for this. Because the client was having financial problems, rather than release my name from the records NYC, ( then job receives a stop work order ) I continued visiting to help him out. Four months later he was far enough along where the building dept. did not require him to have a Const. Supt. any longer . since then no payments towards the debt.

CaliforniaI am looking for a lawyer that deals with contractors for a homeowners case? I am the homeowner and have had nothing but problems with my contractor with leaving unfinished work. Not completing work and demanding me to pay and if i don't he is threatening me by taking me to court and suing me. DelawareIf the Mechanics Lien was not paid when the house was sold. Do we put the previous owners as the Hiring Party? Or do we put them on the Intent it Enforce/Foreclose? And as what party?
ColoradoTo make sure I'm filling out each section of the mechanics lien properly with the correct information, is there a step by step guide that explains each question and what goes in each section to answer all of the questions? This is for form A365. Thank you! If you're not a lawyer, some of the terminology is confusing and I don't want to input the wrong information where it would make my lien become invalidated
