I am an employee/laborer and unpaid by a contractor for work performed on several houses in FL. I understand can file a lien and do not need to pre-lien or notice of intent to lien or give notice directly to the property owner as I am not a contractor, but am an unpaid employee of the contractor. Is this correct? Also, one of the properties sold and closed in only a few days from completion, I plan on placing alien against that property as I am unpaid for labor there as well. I have given notarized notice to contractor of unpaid wages and listed properties and values for each property that is unpaid. As of tomorrow night they will have no further right to address or challenge any of the amounts. I'm a GC working on a residential home remodel. We had an initial contract that the homeowner signed and has made partial payment on. Since we started working, there were added jobs the homeowner asked us to do. We got approval for everything but mostly on the phone. We never did any work without the homeowner's approval and most of the time we were able to give them a quote for how much the added job would cost. They suddenly took an issue with some of the added job amounts and told us to stop working. Most of the jobs were either complete or mostly complete. Now they want to pay us half of what we're owed and this includes not paying us for unfinished jobs (which are mostly done but we had to stop when the homeowner asked us to). We sent an email containing a total amount owed and the homeowner said they'll leave everything up to the mediator. I'm not sure what that even means. I work hard and have never had a homeowner do this. I understand I'd have to prepare a lein and file it with the county. Just want to make sure I'm not missing anything. My partner and I did most of the work but we had a subcontractor do some electrical work. Would I only list the electrical sub in the sworn statement or should I also include all the work we/GC did? And assuming we get a lein, what's next?...Read More

We filed a Mechanics Lien on one of our projects in June 2020. We did not received a notification about the extension. As the year ended we are going back through all of our jobs and noticed that the extension was not filed. We are currently in contact with the GC about getting payment. I am a general contractor in the state of Louisiana. We have a contract for a reroof, gutter, soffit and fascia. We have only completed the reroof portion no other work as the homeowner has ceased to correspond or pay us for the work competed. We didn't file a Notice of Commencement but have a contract and have sent in the invoice to insurance and have confirmation from insurance the homeowner has been paid. If an apartment flooded and the maintenance guys just put fans on top of carpet without removing water. I received call from tenants mother they needed help. I went and removed water, carpet and padding as the water was grey water. A toilet over flowed from wipes being flushed from someone in the complex. The tenants property was getting damaged from sitting in water. Tenant from across the way cane out and asked what I was doing. I told her and she took me into her apartment. It smelt like throw up and mold combined. I asked if maintenance came and they just put fans. I was upset because she had children sleeping in there. When removing carpet I found mold. I am a licensed Construction Superintendent doing Safety inspections on job sites. I visit each job that I have signed a PW2 ( allows client to get a work permit. ) Five days a week I visit the job site and write a report that is then put in the job site log to verify I had been there . If the NYC DOB stops by they want to see the log and that it has been kept up. I receive a monthly fee for this. Because the client was having financial problems, rather than release my name from the records NYC, ( then job receives a stop work order ) I continued visiting to help him out.
