im a handyman and had a home owner hire me to do some repairs around a house they are selling. Then the owner wanted me to paint the walls and trim inside the whole house. they gave me down payment and mid payment. I had excluded replacing kitchen faucet from contract. And there relator had kicked me off the job before i could do a final clean. so now the owner wont pay but is now saying that i owe him more money then the job cost to repair the (damages) which are dried up colored water spots from cleaning the paint brushes in the sink. What if the project was suddenly stopped or terminated by the owner and we weren't able to send a prelim notice on time, do we / can we still send a prelim notice and then file a mechanics lien to the owner of the property? situation: we are a subcontractor and doesnt really have a habit of sending prelim notices to all the jobs, only a few with big contracts. I wasn't sure if i sent a prelim notice for this job that we have, but we were surprised that the general contractor was terminated from the project and the owner will not be paying anymore, which is causing the GC a problem since they have subcontractors and we are one of them. Now, since the owner is very stubborn, we have to file a mechanics lien to get the money owed to us. Hello, I had a terrible storm hit my subdivision, causing major hail damage to my home and garage. I hired a contractor back in early 2020. He was a door-knocker insurance contractor. He played a sob story of he is a single dad, raising his daughter on his own (she was with him). I too am a single parent, so I hired him for the job. I thought I was doing the right thing, but it turned out to be a homeowners worst nightmare. It took the John (contractor) over 8 months to complete 2 Roofs (house and garage), gutters (house and garage), a very small section of siding on the back of my house and awnings on the house (another company was hired to do). I have multiple violations per the city building inspector on my roof (house), currently. There is also work per the insurance estimate that was not completed by John, including no materials were ordered to perform the work. The contractor is currently sending me threatening and harassing text messages. And of course he is threatening to also put a lien on my house. I paid John almost $9900 the insurance company issued as the depreciation check, the full amount in the check. He is stating I still owe him $4600. The breakdown is $1942 from the materials check issued from the insurance company (for work he did not complete and poor craftsmanship), $1692 that is my deductible, even though he told me verbally he would take care of that. He did not subtract $300 for having his sign posted up on my lawn for 5 months. And $973, an additional check issued from the insurance company for the awnings that have already been paid in full to John and to the awning company. I live in a homestead property in Texas and had pipes burst during the freeze in February 2021. My "friend", who is not a certified plumber, assessed and stopped leaking pipes in my attic. He "gave me an offer I couldn't refuse" if I called around to find materials, which were very hard to locate, and if I also picked up those materials. He later stated that his "discount" was $225. He showed up on February 22 to assess the problem and returned on February 24 to "repair" the pipes. Due to the lack of materials, he did not replace the pipes, but he stopped the leaks with Pipe Repair Clamps, and he cut and sealed another section of leaking pipe that was no longer in service inside the house. He left without mentioning the charge for his repairs. I wanted him to receive some sort of payment, not knowing what the charges were, and sent him a good faith payment of $100. I figured when factoring in the $225 discount, the amount of $325 would suffice in covering the work that was completed. Well, unfortunately, he was INSULTED by this and went on to state "his initial repair cost to replace the busted pipe with PEX was $600" - this was never disclosed nor was this what was performed. He has now sent me an invoice for the full amount of $600 plus tax. Is that even legal? I did not agree to that price. That price was never disclosed to me prior to performing the work. Florida, Orange County. Irrigation jobs for private residence. I’m a subcontractor. I want to be able to lean on property if we do not pay when I’m finished with the job but do I have to send some thing out prior to filing the lien. I don’t think we have to do a notice to owner in this state. I just file the lien if they don’t pay or what steps do I need to take to ensure I can file a lien at the end of the contract...Read More

I put a lien on a job that I worked in December I am the sub subcontractor and the sub we did the job for wasn't paying, we decided to stop when we were half way in that 5th floor.
