Hi there - we are homeowners who hired a contractor to complete some work on our detached garage that was damaged in the flood. He ended up charging the insurance company for more work than was actually done, including inflating the actual square footage of the property from 800 sq ft to 1500 sq ft. We are refusing to turn over the money from the insurance company to him as the work was not done, but he is insisting he get the money because the insurance company gave it to us. We've also reported this to the insurance company and are trying to repay them for the overages. He's telling us to pay or he'll follow a lien. Any advise?...Read More

I am the direct contractor for a residential remodel. I have a contract that I have not been paid on. The work and request for payment was submitted late June and we have been back and forth with regards to payment. They are not completely satisfied with the outcome of the project, specifically and singularly the paint. They are withholding 50% of the paint cost, which is not acceptable. I have e-mails that state that they are not happy with the finished paint look and not the application. They then said that every wall in the entire house needed to be repainted. I said no, I was not going to do that. At that point I offered to take less than owed so they could hire another contractor for paint as it seemed that whatever I did to correct any paint issues they had they were not satisfied. Their response was that they are not paying anything. So here we are.... Contractor and insurance adjuster cannot come to an agreed number for an insurance claim . The contractor started the project without sending in an upfront estimate . 3 months later the adjuster sends a check for the amount of the insurance estimate . I provided materials and labor for a neighbor while helping him build a barn and run fencing. Gave my help in labor for free since we are neighbors. This transpired at the early rising of covid and my remodelling business was on hold. Finished the barn and we both discussed an add on to it. I offered my Lowes business act to order the materials from as long as he would repay. Neighbor agreed. After delivery he and I had a falling out and did not talk for a few months. When we would talk it was abrasive and harassing. I would inquire about material repayment and would get an excuse or a promise date and sometimes he would refuse to pay. This went back and forth for 10 months now. I have sent him invoices and copies of itemized lists of the materials to show the amount due which he is now saying that I did this on my own and he didn't order anything. There is only a verbal agreement and what messages I have to show the timeline. I am just now researching on how to recoup this amount for my business and found that I may have missed the deadline for mechanics lien. Tenant wanted to build apartment in my barn. I wanted a toilet, shower, and bedroom in there for my own use when I am there. So I said ok. He said he would pay for all materials and provide all labor. He built an extravagent apartment thinking he and his wife would someday buy my property and live there themselves, renting out the other houses. Since then his wife has died and he learned he could not buy my property because I am not ready to sell it. Meanwhile against the rental agreement he has been subletting the apartment for $500 a month to an uncle who helps him with his 3 kids. Over the course of the project he asked for me to help out. I twice gave him $2500 he was supposed to pay back. Since he can't buy the property and will now have to move out, he is threatening to put a lein on my property to get compensated for "ALL OF THE MATERIALS AND LABOR" he has put into the property. We never had a contract. I never agreed to pay him anything. I never had any control over what he chose to build in the barn. I did some work on a car for a friend of a friend. While waiting for the guy to come pick up the car and pay me, I found out from our mutual friend that he died. From what I understand, he has no family or heirs. I would like to keep the car as payment for the work I performed. How do I go about doing that? Good afternoon! We're an architectural firm in Illinois that was hired by the GC/Owner's Rep. for two projects; we have not received any payment for either project. First invoices were issued in November, 2020 and December, 2020. Total amount due is over $80K for both projects combined. Our Client claims that numerous checks were intercepted and fraudulently deposited. Our last communication with the Client was via email on 6.21.21 when she informed us that the funds would be deposited into her account between 48 and 72 hours and she was going to deliver the checks to our office personally. That didn't happen. I left several voicemail messages and sent several emails and have not heard back from our Client. We have never filed a lien before so I need assistance with selecting the correct form and completing it as well. Are we required to file a notice of intent prior to issuing the formal lien? We have learned that the NY lien claim must include an address of a NY attorney upon whom service can be made to the lien claimant. Is there a service that provides a NY attorney that does this service every day at reasonable rates? Is there a recommended way to do this?
