We are a general contractor in Ohio. We generally complete projects through a mix of using subcontractors and self-performing work. We recently completed a project for a public entity (a township) that did not file a notice of commencement. They are refusing to pay. Can we file a mechanics' lien?...Read More

We contracted with a fence builder to build our fence. We sent them $3992. with the balance due upon completion. It was supposed to be started the middle of June. I have called, emailed and went by their office. No one there, doors locked. What steps do I take to get our deposit back. This is Superior Fence in Cumming, GA. Thankyou Kathy Milstead...Read More

Is it too late to file a mechanics lien on 2 properties in Alabama, that we installed new HVAC equipment for, if we installed on December 7 & 8th 2020? Both properties belong to the same person, and the agreement was for the lady to pay in full, same as cash, within 90 days, and if she failed to do so, the contract was to revert to a 36 month rent to own contract, at 10% interest, beginning 3 months after the date of installation. She only paid the first months debt, and has since not paid a dime, nor can we get her to respond to any types of correspondence. It also stated in the contract that we could "repossess" the equipment, if she doesn't pay. One of the properties are a rental home, and the other, is her primary home. ...Read More

An architect created designs for a project in my single family home. He never provided any quote for fees or pricing. After a couple months of discussion I decided to end the project verbally and via email. He then sent me a bill for his designs 4 months later with prices I never agreed to. I asked for clarification on the pricing and he never responded. Now, 8 months after he last created a design for us he is threatening to place a lien on my property. No physical work has been done on the property. He only created designs. And it has been 8 months since the last designs. Can he truly place a mechanics lien on my property or any other type of professional design lien? Thank you. ...Read More

My name is Greg Carter and Dan Ellis as a girlfriend and she needed a deck on the back of her house improved on I gave them a written quote and required a 50% down payment to start Dan paid me the 50% deposit and I started work on the deck after some of the items were completed he wanted to do more work and to add more wood to make the deck look new Dan bought a lot of the wood and then he also paid me to to purchase some of the wood we agreed on labor pricing for the additional items he wanted done he also agreed to pay me 2 haul off the old deck to the landfill and wanted me to do some waterproofing on a sliding glass back door spent several weeks working on the improvements and was almost done I only had a few touch-ups and some painting left and the project would be complete he told me on the last day then he didn't want me back on the job and that he wasn't going to pay me 4 those things that I had completed because he didn't think I was doing a good job he told me I needed to deal with a general contractor that I have no previous contact with and was in no negotiations conversations prior to him not allowing me to finish so I talked to that general contractor he looked at the work he said it was good and Dan was being unreasonable and didn't know why he was being difficult so my question is his girlfriend owns the home and he is the one that set this all up and was paying for everything but I need to put a lien on the home that is her name how do I do that? My email is gdawgc.cg@gmail.com...Read More

I hired a contractor to fix the drywall in my basement due to water damage. This was an insurance claim, and the contractor was a preferred vendor for the insurance company. I paid my deductible to the contractor, and my insurance company paid the rest. The contractor hired a drywall company to complete the work. The drywall company wasn’t paid by the contractor for the work (it’s only been 30 days since the work was completed.) The drywall company is calling me threatening to put a lien on my home. Can he do this considering I was contracted with the contractor not the drywall company, and I paid everything in full. ...Read More

Ok so I let my father borrow my truck for a little while and in the process he had to do some "repairs" and actually ended up tear the entire motor apart well he could not get the computer to link up correctly and took it to a repair shop and I'm assuming did not pay because they have put a mechanics lein on my truck and as my father states are holding the truck until payment. Problem is that I did not agree to any of this being done and would just like to get my vehicle back so I can make necessary repairs. Is there anything I can do?...Read More

We completed a project in a residential home and the homeowner used their insurance check to buy furniture instead of paying the contractors. Our customer is the contractor and we are the subcontractor. The contractor has already filed a separate lien and is seeking to sue the homeowner to enforce his lien but that does not protect our interest. Please advise us how we should proceed....Read More

I'm a restoration contractor who completed work about 3 months ago for a homeowner. The homeowner's insurance adjuster took about 45 days to respond and issue our payment. We then sent the check to the homeowner to endorse but he is now refusing to pay. Can a lien be filed or do we have to pursue our payment in court?...Read More
