I recently got a letter notifying me that there was a construction lien on our house. The letter was through the NE Register of Deeds. The issue is our contractor stopped showing up, so we fired him and had someone else do the job. 130 days later he filed this lien. He lied on the letter about the last date he worked so that it would still appear as if he was within the 120 day window. (I have everything documented in writing). He also lied about the contract amount. I have read that I need to send him a demand letter that he needs to initiate judicial proceedings. Is that accurate? After I do that, how do I go about getting the lien removed because I don't think he will file the paperwork to remove it. Thank you!...Read More

We hired a general contractor to remodel do 2 bathrooms. After he said he was done we noticed issues with his work. He didn’t do what he was hired to do. The wall was not completely done the bathroom door was not hung properly and the shower didn’t drain properly. We brought these to his attention and he came out a couple more times and didn’t fix any of the issues he refused the redo the shower floor and only did half of the wall and didn’t touch the door. He once again said he was done with the project There is more to the issues regarding tearing out the bathroom months before he starting the construction etc We had to hire someone else to fix his mistakes and now he is putting a lien on the house for the final payment that we didn’t pay since he didn’t do the work properly as promised ...Read More

I am a licensed contractor who did work for an HOA in Phoenix. I dealt exclusively with the association community manager who I have worked with before for this community as well as one other. He's always paid for the work done. This particular job was one that he has been expecting to fund through an insurance claim. They obtained a replacement title without notice to the owner of the vehicle who has the original title and sold the vehicle. No notice was given to the owner of the vehicle. So we paid are under a contract with a contractor, the job is not done to completion at all and he will not answer our texts, calls or emails. Our contract was written where we pay for half the job and the other half at completion which we are still waiting on. We received a mechanics lien on our door today because the contract has apparently not paid the subcontractors for work. It is not legal because it has not been notarized. We cannot get ahold of the contractor to get any of the punch list completed nor has anyone been out to our home in months. Are we liable for anything with the mechanics lien if the contractor hasn't paid them? We have a building that was upgraded to a manufacturing facility. The facility went $433,000 over budget, we had hoped to be up and fully running by now, but DHSS guidelines restricted our opening date by 94 days and we are just getting going. The work on the facility has had issues, mainly with the vent buildout above the stove in our commercial kitchen. We are working to resolve this, but we have lost many days of baking due to humidity and the safety system setting off the fire alarms and shutting down the oven due to the venting issue. We are now being told it will be another $25,000 to fix this. We changed construction companies about 1/4 way through the process, so now it has become a name calling of who is responsible. Meanwhile, we are 6 months out from our completed construction on 8/10/21. We have had one Notice of Intent to File that we were able to make a payment on and a payment plan. We just got notice of a second. My understanding is that we have longer than 6 months if the corrective work is not complete, but not sure how that works since we cant afford the fix at this time either. But my main question is about our bank, we want to be transparent so we would like to know if they weill also be notified of the intent or just when the actual lean is filed....Read More

I’m Kristi from Kristi Kleans, I was subcontracted to deep clean, and Then maintenance clean 5 nights a week a Shakeys pizza parlor from Randy Edny/owner of Pro Resturant Clean, who said the owner of Shakeys hired him. We signed a contract. The general manager of Shakeys was my contact and said I did a great job and was very happy with my work. Upon completion of the deep clean I was blocked by Randy Edny, and haven’t been paid and I can’t get ahold of him. When I went by Shakeys the GM told me to talk to the man who hired me…. Who I can’t get ahold of now…. So what do I do, I am out thousands of dollars and can’t believe this is happening to me, please advise me if I can do this or not.
