CNN Construction in Hillside IL just issued use a mechanics lien for $6k non-payment for a roof service. They completed the work in May. Insurance paid for the estimate in the amount of $8500. They received payment before the work started. We waited a week and work finally was done. Then we get an invoice in August stating the work was around $14000 and that they added some upgrades. We were never informed of these "upgrades" and in fact the upgrades were not done (ie new gutters which they added $3k for). We reached out to our insurance to see if they notified them of any adjustments to the estimate and they we not aware nor were they contacted. The claimed the work was completed in August but it was not. It was completed in May. They sent threating emails and called unlisted and left nasty phone messages saying they would issue a lien if we didn't set up a payment plan. I'd like to know what I can do to get out of this nightmare with them. Thank you....Read More

in 2019 i have hired a builder to build our home. the bank paid him but it seems that he did not pay his contractors. so 2 contractors put a lien on our property in august 2019. the builder went brankrupcy and the contractors that were not paid did not attempt any action. how can i resolve these lien as i would like to refinance my properties...Read More

We completed the work about three weeks ago. The general manager told us, and I have the emails for a reference, That a check would be issued following Thursday after the work is completed. The general manager will no longer return our calls or emails. The last time that we had talk to her, she said that the work order was turned in on August 26. We still have not received a check. We are a general contractor in Alabama. We did some work for the DNUS facility in Madison Alabama by PO for Baseline electric based out of Kentucky. They had a contract with Marubeni who had the contract to deliver and install from DNUS. Our PO was a time and material PO with no fixed price. Work orders were signed weekly by Baseline. Baseline complained of slow payments from Marubeni but in reality he has received almost one million in payments but only transferred $218,000.00 to us. The second issue is his contract apparently with Marubeni was 1,240,000.00. He advised them early on due to Covid overruns are to be expected. To complicate things Marubeni is claiming baseline was not licensed in AL. In my opinion this is their omission as they contracted it to him and we had no involvement in that contract. Also my opinion they should have gotten partial lien releases signed each month to ensure we were receiving the funds. Where do we stand in this situation...Read More

I recently tried to start a new business in a commercial building in my area in Wisconsin. I was sold the building as turn key ready to work well the township and county had other ideas and I have been jobless and fighting to open ever since. I had started an LLC for the small engine repair shop. In the meantime since I couldnt open up my business at my location I decided I better fund some other work. So I went back into the trades as I was just before I started this LLC and took on a big project. I contracted a remodel job for a bar/restaurant plus living quarters. In my area. I have received very little payments and it appears as if the owners are going through some personal struggles. I'm near finished with job and I'm owed a pretty hefty lump sum. My question is if it is better to run this job through my new LLC to show some income in my business and have the protections of an LLC or am I; better off doing it as a sole proprietorship? Since my new business is in mechanics mostly not construction I'm thinking I need to do it as sole proprietor. If so what are the risks?...Read More

We recently hired a contractor to do work in three closets - add shelving, add a small built-in desk, change doors, add lighting, etc. He asked for 50% up front for materials, 50% at completion, which we paid. About a week later, he sent a photo of the built in desk for approval. The desk looked awful, so we did not approve. He got really defensive about it, so we told him to cancel the project and please deliver the materials that we have paid for. He is now refusing to return the materials, and threatening us with a mechanic's lien, saying that he spent more time on this than we've paid for, and we owe him for that. He has done no actual work in our home. Can he file a lien? Can we at least get the materials that we paid for?...Read More

I am a project manager. I was hired to find a gc, all subs and all supplies for basement remodeling. Client decided to not pay anything above what I paid out and we lost 20,000.00 that we were really planning on when we got nixed from the job. On a deadline of a baby due date we busted our tails to complete on time. The drywaller that was hired through another gc on the project (framer) , was paid in full and decided to go to the homeowner and say he was not. He ransomed the job for almost a month. So to be done in time,, we hired our team to go in a knock it out with us.. We bought all supplies and half way through he shows up. He talked bad about all of our work (that was not complete!!!) and the homeowner listened to him and not me. Not sure why. He told him that it all needed to come down, drywall and all. (He hung the drywall btw) HO heard he could finish faster and not only paid him AGAIN, but paid him 5000.00 to tear out everything we did. It only needed to be sanded and thats all he did.. He never removed anything! HO said he'd take care of it, and we could go. Mind blown. I think my only option is to file a lein to be reimbersed. Is that correct? I put in 3 months of work on this job. We did everything. We hired electrician, plumber, hvac, bathroom, carpet (which I canceled) framer, insulation and GC. I applied for and obtained permits, and met inspectors, with GC and was there for every thing that needed to be done. My team was there, my company was very much responsible for the successfully completed jobs. We need to pay the people who werent paid in the process. I was referred to an investor who owns a property and as a contractor I agreed to help them remodel the home inside and out to prepare it for rental. I was very busy and had part of my crew work on that project as I was working between there and another home. I was referred to this gentleman from a friend and felt more comfortable than I should concerning being reimbursed for materials and labor expenses that we had agreed upon. There was a person who supervised the project who had no knowledge of construction who kept leading me on that the owner was out of town and reimbursements would be made . I had spoke with the owner and he assured me that I would get paid once I submitted receipts and description of work. I am very detailed and keeping my books as well as notes on work completed along with pictures which were given to the owner periodically through project . The supervisor began causing trouble trying to hire my workers from underneath me and other issues with now I can see was try to scam me for the work I completed and material at purchase. There's no good way to put it but these people are very corrupt and it appears they never intended on paying me anything for material or labor. anyone who reads the communications between the order and I can see there was a divisive plan to con me out of my money . I wish there was something I could do to charge them with deception and Theft over and above the mechanics lien but I am satisfied if I get my money back from the job.
