I have a contactor who sent me several change orders for work that I never agreed to pay for after the work was already completed. There is no signed contract or estimate for the work. He is now threatening to file a lien on my house if I don't pay the extra bills that I never agreed to or knew were coming until after the work was complete. Can he actually file a lien on my house for this, and what rights or recourse do I have to stop this?...Read More

Owner hired a licensed GC to perform work on a building. GC then brought day-laborers to the job site, and allegedly didn't pay them. GC has disappeared and filed for bankruptcy. Laborers, through the Labor Commissioner, recorded mechanics liens 100 days after cessation of work on Owner's property. Included numerous claims in their lien that are likely false, and likely cannot be proven. Laborers then filed a lawsuit to foreclose for unpaid wages and interest 91 days later against the property manager, assuming he was the Owner of the property, when he was not. Afterwards, Laborers filed an amendment to their mechanics lien another 6 months later after the original lien/cessation of work, requesting even more money, without any reasonable explanation. Finally, the Laborers then filed a lawsuit to foreclose on the amended mechanics lien 6 months after recording their mechanics lien. (1) Are unpaid wages and interest the appropriate measure of damages for laborers in this scenario? The reasonable value of the work is close to nothing, because Owner received no benefit and had to pay a separate contractor even more to perform the work the Laborers asserted. (2) Is either the original or the amended mechanics lien valid, given the timing of their respective lawsuits? Do they relate back?...Read More

What is the repercussions to a homeowner if a lien is filed. I have an issue with a contractor who has not delivered the concrete patio they sold me. They told me it was a 3 day project and it has now been 30 days. They continue to tell me that they are going to fix the patio but I do not think they plan to do it correctly. I have said the patio needs to be completed correctly or final payment will not be made. They have said if I don't pay they will file a lien and it applies immediately and will shut down any other work on my property by other trades and I would not be able to rent out my home while we argue thru the courts. Is this true? My understanding is the lien goes against the property and if I want to sell or refinance the home is when it would affect me. Which is correct or if both are wrong what is the process?...Read More

Hello I am a designer/draftsman for a large home in Texas (I am not an Architect and do not claim to be). The client used an LLC to engage our services via written agreement and has not paid an invoice rendered for over 6 weeks. The agreement was a specific date based payment plan over several months and not tied to outcomes as the client's business manager has a history of frustrating the delivery of outcomes. The recommendations called for in the agreement were provided however the client has ignored them. Do I have the right to place a mechanics lien against the property the design work applies to? Thank you...Read More

Hello— I recently received a certified letter from 2 men stating they would be filing a mechanics lien against my property. These men are apparently ex-employees of a company I hired to do foundation repair on my house. They are claiming the company didn’t pay them commissions while they worked for this company. I have paid the foundation repair company in full for their work. I have no idea what these men are talking about. These men did no foundation work on my property as employees of this company or otherwise. I called the company and was told to ignore the letter- these men can’t file a lien. Can they file a mechanics lien against my property? Will the state of California issue the lien? This seems to be a fraudulent attempt to extort money from me, but I am concerned I should do something more than “ignore” them. Thank you for any advice you can give me....Read More
