I am an independent commercial truck mechanic. I do not have a signed contract with this customer but i do have a steady history of paid invoices for work with this customer. I recently had them verbally agree to pay a bill on 2 occasions, after the repairs to their vehicle were made they decided to not pay the bill. I contacted property owner to see if they were interested in selling property they have not been to in many years and was told yes and agreed on 17k and was told to go ahead and do what I wanted to do with it as it was mine now ,so I did tons of tree work to get up to city ordinance. I have many hours of labor and receipts from hiring others for services. There’s well over 10 k in my time and hired time. As time went on I tried to pay cash to owner but she wanted a realtor to drive with me 4 hours away to fo papers and I don’t know any realtors willing do go so I had one contract her . She then would not answer calls for a month or so then she did and said everything is good but she now wants more. I agreed to the new price of 18 k because it’s connected to my property and I don’t want anyone else to build in my view. Then I don’t hear from her until she and her son in law and his wife show up at my house and we discussed me attempting to pay her over and over and they agreed to call me to discuss more about everything because I think the woman is not 100% comprehensive. I have attempted contacting all of them many times but no response so I don’t know what’s going on and afraid they will sell it while I have already invested much time and money into property . I wrote a check "payment in full" for a dispute with my general contractor on the very top of the check and on the bottom in the memo line. The contractor scratched off the language - payment in full in the memo section but left the language on the top of the check. I am a steel subcontractor working on a public job in Alabama. I have two separate "contracts" for this job. A purchase order for the steel materials and a subcontract for the steel field erection services. The GC has had all kinds of problems on this job and is likely facing some liquidated damages. As such they are looking for every possible pocket to back charge including mine. No matter how false the claims, they are using a "throw it against the wall" approach and see what sticks. Yesterday the informed me they are holding payment until they can confirm or argue many of their so called "back charges" for delays. So, I would like to file liens to protect myself. (a) do I need to file separate liens for the PO and the subcontract? I would think I would? (b) I currently have billing that is 20 days past due and more coming due in about 15 days. I had a masonry contractor repair a brick porch on my house. The repairs are of unacceptable quality, and some areas needing repair were not completed. the contractor sent their employee twice to supposedly address this, but they only made the situation worse, and still did not complete the repair. My wife and I inherited my recently deceased step-father's landscaping business. We are shutting it down. We have one affluent customer who is refusing to pay a $46k bill. She signed a release of work at a per man per hour rate (which I have). She used more man hours than she anticipated (this was during the ice storm earlier this year). I recently fired my general contractor for defaulting on our construction agreement. We had a fixed price contract for renovation of the home I currently occupy. I have offered to make a final payment which covers the outstanding balance for work completed but the contractor is angry and demanding a much larger sum that does not correspond to work completed or to the schedule of values for the contract. This is a lender financed project so the amount of the final payment is limited to the value of work that the lender's inspector could document as completed. I am concerned the contractor is going to file a construction lien for the amount he asserts he is owed beyond what I can pay. To protect myself from this I filed a notice of contract termination. More than 60 days has passed since that filing. From the clerk's records I learned that he did not file our contract (with a fixed price greater than $100,000) until after I filed the termination notice. He also started work 6 weeks before we signed a contract which the contract itself notes. Does the contractor have lien rights against me? Hello, My company supplied and installed cabinets in a home that was damaged by a flood. We were hired by a restoration company. After our job was completed the company refused to pay us, saying the other contractors are not complete and the clients insurance will not pay till the job is signed off of the home owner. This was in April.
