I'm an electrician and did a few jobs for a friend of mine. I wasn't an llc at the time but I am now. I found out that he does not have his GC license, also the remodel jobs were generated and overseen by another company, A-Line Contractors. They have both revised to pay for the work I've done. A-Line is now stating a reason, due to the notice of intent to lien I sent, that I misrepresented myself as a licensed electrician. I never did that. I have recorded phone calls discussing that very issue, and being told that they had a master electrician whom pulled permits for the jobs and would oversee them. To this point there are no complaints of quality of workmanship and a far stretch to produce one. My earlier intent notice was sent to A-Line for only 1 of the jobs, in the amount of $5276.54, for change order and out of contract work. This work was done by me, at the behest of the home owner, and both A-Line and my friend(who does have a registered LLC) were fully aware of. In fact that work was about 90% of my activity on the site, and involved many special instructions and guidance from each of them. Also documented in recorded calls and text messages. Even a call to A-Line re my concerns about being paid, to which I was told it"would be taken care of". I don't have any written agreements with either company, only calls and text messages over a period of several months. I believe, given their content, they will serve as sufficient verbal agreements? Should I, and can I, lien both? I'm owed north of $6500 combined, which includes $500 still not paid on the contract from the job I spoke of. Additionally, I feel the cease and desist letter I received from A- Line leans pretty hard into extortion territory, the way I interpret the law in Colorado. Given the threats leveled at my reputation and livelihood by "reporting me to the authorities " and sueing me for return of any monies paid to me, plus attorney fees, ×3, if I proceed in recording the lien. If my lien action is legal, a lawyer would know this, and I don't believe he would threaten such extreme action, knowing he can argue against its validity in court. Threats that so closely borderon illegal. I have a suspicion that the lawyer is maybe the son of a lawyer, using dad's credentials. I don't find anyone registered with the Bar with the same name, but with jr as a suffix. Not sure if it matters, save the fact that if I'm right, he's definitely breaking the law. I was hired by Mrs colon who had a insurance job and needed the basement tore out and then new concrete poured insurance approved the bid she told me to start and then a few weeks into it the ins adjuster got fired and new one came out the said check was coming over and over and then her mortgage company sold her mortgage to another mortgage company which delayed check said fill this out and sign waiver to original mortgage company with the box already checked for unconditional the when mortgage company new one took over kept sayin check expedited whil the whole time she made other arrangement had a leakage system put in and kept asking us to do next thing and only gave us 18000 and that wouldn’t even cover the subcontractors and bid was for 57600but changed everything and did things weren’t originally on bid she went on three trips and then after we’d done doing everything but clean up said this is what I’m paying u this is what I think u should get out of the entire payment and then tried to sue us after and judge laughed at her and now need to file lien...Read More

My company provided material, asphalt, to the contractor who performed the job. During which one of our truck caused damage to a curb, which we fixed, now the contractor is finding other damages that that occurred after we finished delivery and they are wanting us to pay for them as well. He is not wanting to pay us until those damages are fix. The damage to the curb was in fact our fault but we can not take responsibility for damages that occurred when we were not present on the job. I own property and have contracted Concrete work which is now happening. Yesterday a Concrete Truck (from "RC") showed up at my house, (with my address on the order) and was refused by my Contractor, who claimed it was ordered by a different person / company. (yes, it's fishy.) The Concrete truck returned to the RC lot. RC have told me that the order was placed by a different person (with different company name) from my contractor. My contractor claims to not know who ordered it. Now RC says they have been advised by their legal counsel to "inform me that they intend to file a lien on my property for payment of the Concrete delivery", which I did not authorize, or order. Do they have grounds for a lien? It seems to me this would be a Fraudulent Lien since they have no contract with me (the property owner, or interested party) and I did not authorize the delivery, or commit to making payment. I have a customer that we have worked on a project for a year. The manufacturer made their windows wrong seven consistent times. We have been done with our work since July 2021. and finished the warranty work last Thursday. He has taken a self proclaimed discount of nearly 5000 for pain an suffering because of manufacturing mishaps. While waiting for warranty glass from the manufacturer. We initially took the down payment by credit card but have change our policy on credit card and not processed since because of fees for the construction industry.
