I'm the builder. We get lien waivers from our subcontractors when we make payment. Do the lien waivers that I'm getting protect us if the subcontractor does not pay his subcontractors? For example, if we paid & collected a lien waiver from a demolition company but our demolition company did not pay the dumpster company, are protected from the dumpster company filing a lien?...Read More

A GC is requiring us to sign an unconditional waiver before releasing a check to us. We are at an impasse - I don't want to provide the waiver, and they won't pay us without it. I'm happy to provide a conditional waiver, but they will not accept that. I know it is not smart to sign the unconditional waiver before receipt of the check, but is it technically illegal (in Texas) for them to require it? Thanks....Read More

I normally work on private projects where subcontractors provide lien waivers with their monthly payment applications. I am working on a federal project and my understanding of the Miller Act is that there is no "lien waiver" but rather "bond claims". Is there any monthly documentation (similar to a lien waiver on private projects) that subcontractors need to provide monthly on federal projects? Or is the process just that they file a "bond claim" whenever they are not paid?...Read More

I represent a steel supplier for a project in south Georgia. This is a big project with many subs, my client being one of them. There is a major dispute with the GC over alleged chargebacks and unpaid invoices. We are still within the 90 day time frame to file liens on the property. However, a Notice to Contractor was not sent by my client. A NOC was provided late but it is not signed by the clerk of court. I am verifying whether or not it was ever filed. One point: 1. We do have privity of contract, a direct contract with the GC. It appears that although best practice would have been to send a NTC, it is not required by Georgia law because of the existence of the contract that we have with the GC. This document waives rights unconditionally and states that you have been paid for giving up those rights, this doc is enforceable against you if you sign it even if you not been paid. use a conditional release form. I indicated to the GC a lien would be filed on a project, the GC stated they would bond around it. Lien was filed, now they want me to sign a partial lien waiver to satisfy a Vendor. Vendor is willing to accept payment or will file suit. GC wants me to sign partial waiver to release joint check to Vendor. GC requests I adjust lien amount from 61K to 18K reflecting the payment made to Vendor. Can I adjust the lien amount after it has been filed? This is a huge mess, the GC is claiming I violated the Trust and misappropriated funds as another scare tactic. After digging around I have found that the GC is notorious for not paying 100% of contracts or change orders. One side of me wants to give up and the other side wants to fight to the bitter end.
