With everything going on these days I'd hit Financial hard times and I had asked a friend of mine if I could rent their RV. We Came Upon of an agreement that I could stay in their RV for $400 a month and 4 payment of that $400 a month I was too repair the RV it maintenance and upkeep to the RV and yard. Anyting over that $400 a month he would reimburse me for whether it be supplies materials or anything else needed to establish the upkeep and maintenance of the RV and yard. And now they are refusing to pay me for my labor and supply cost that I have had to put into the maintenance and upkeep to the RV and yard. And since I moved in to the RV March of 2021 I have put in approximately 8 to 10000 dollars into labor cost and materials and he is refusing 2 pay me the difference and is trying to say I owe him money for staying here in his RV is this something that I can file a contractor or mechanics lien on?...Read More

We are a GC doing a private commercial job in MN. Currently, we require Conditional waivers from our subs with each payment application they submit. We are currently working with a lender who is adamant about us requiring Unconditionals from our subs after each payment and before subsequent payments. We have a bit more leverage with Conditionals as subs must turn it in with their payment application, and then we know when it becomes valid because we directly pay them. Additionally, our subs are safer and more willing to sign a Conditional vs an Unconditional. We have offered to provide the bank with the Conditionals and then confirm payment with a check register as proof that those subs have been paid, but the bank is determined to get the Unconditionals. We are concerned that if ONE sub does not turn in an unconditional waiver or is late, it will delay owner payment to us and thus delay payment to the rest of our subs. The bank is concerned about, and our question is: Is a lender who records a mortgage after construction starts at risk (of the sub being in first position for a lien) for the duration of the project? Managing the lien waivers - does the type matter or not if the lender is in 2nd position for a lien and if they do matter, does being in 2nd position get absolved as of a certain date? We usually don't encounter this issue, but post-covid, A LOT of banks are now asking us for extra waivers and paperwork and pushing back on our solutions to mitigate that paperwork, while still ensuring and proving that we are tracking waivers and paying our subs. Every bank has a different request, and usually, they are fine with getting the Conditionals and check register as proof, but this bank is really pushing back because they are concerned about being in this "2nd position" for a lien, and say the Unconditional will protect them from that. 1) I am a home owner in California. When I pay my contractor, does the Conditional Waiver and Release signed by him, cover me against liens from his suppliers, or do I need to ask him to provide me with Conditional Waivers from each of his subs or suppliers as well? 2) In the latter case, above, does my canceled check to the contractor cover me even if my contractor fails to pay the supplier he got the Conditional Waiver from, or must I insist on joint checks or payment directly to the supplier? 3) Can contractors licensed in California legally refuse to provide these if requested by the owner? I am a subcontractor for HVAC work done at a Gold's Gym in Arlington VA. Our supplier York international who provided roof top units has filed a lien for non payment We are being told by the owner and GC that they must submit a release in order to get final payment. However, I have not been paid in full as they are submitting back charges that we were never made aware of until yesterday and the project t is complete. They owe Over $60,000 in retainage and CO but want to reduce our contract about $17,000. Do we legally have to pay YORK to release the lien even if we are not fully paid? Howdy, Question for ya... We are a supplier located in eastern North Carolina and currently utilize the NCLTA Form 6 for all final payments. However, yesterday the webinar introduced me to the conditional version of lien waivers. I am extremely new to both the field and industry and want to ensure I am taking every measure possible to satisfy our customers while protecting our company. Habitually, we take the dreaded "leap of faith" and sign off on small balance liens. Yesterday sparked an interest regarding the utilization of conditional waivers. We are constantly told by GCs that they "need the closing money to pay". My assumption would be to use the conditional on final payment form. Are there any exceptions that you recommend including or tips that you may have? So, that our GCs can close on the property while still being held accountable for the remaining balance and without our employees committing perjury? I cannot travel to Mississippi to file on our behalf with the County Clerk that the project is located in. I just want to be prepared if we have to move forward on this one in the timeframe. I am a Lic electrical sub contractor Started job 3 26-21 ended 6-22-21 balance owed is $6,600 they gave me $3.000 for materials 1rst week into job used $1998 for material.Kept $1002 finish job per scope with added work done as needed and at owner request.was giving another $1,002 2 weeks ago.Gen contractor did not get paid nor me,I've turned in about 8 different invoices over the course of job to no avail,In Texas what do i do to get my money?
