We are a wholesale company located in GA and supplied material to our customer who now owes us money for the material. He apparently was contracted to do a job in TN and the contractor/owner is out of Illinois and he is now asking our company to sign the below Illinois lien waiver. We do not feel comfortable doing so but, he is telling us it is needed in order for us to get paid and that the company that contracted him is going to be paying us with a check made payable to us and to his company. Please tell me i am correct in NOT signing this. I did the hangfinish and paint on a very large residential shop and have 1 day of painting left to be complete and owner says he's not paying anymore . Says I've been paid. Hello I am a client of yours with an active account and need to get unconditional release of lien forms signed by every employee on the job. Is this form different than the unconditional release for a contractor? I am a subcontractor, who hired a subcontractor. I put their guys on our payroll to make certain they were paid in full for all of the work they did, but I do not want them coming back on me in case they were promised something like a bonus on the job by the subcontractor I hired. We are a subcontractor with an agreement to provide services during the Project Development Phase. After requesting preliminary notice information, the contracts manager for the prime contractor noted that since this is a PROJECT DEVELOPMENT PHASE project, the preliminary requirements are not the same as actual construction. They are requiring us to provide lien releases. How do we protect ourselves for this phase of services/work? File a preliminary notice for this phase/type of work? I am a subcontractor on a large commercial project and I am being told by the General Contractor that the owner needs all of our subs and suppliers to provide unconditional progress releases for the invoice month in order to process our invoice for payment. However, many of our subs and suppliers on this project are stating that they will not provide a release because they did not file a preliminary notice on the project and they do not have the project setup with a job number in their system either. My question is: If our subs and suppliers did not file a preliminary notice and do not have the job setup in their system, do they have to still provide us with an unconditional progress release when asked to by the GC and owner? ...Read More
