I am a subcontractor. I have signed all the proper forms of release to get payment. I haven't received my money. The other contractors have. now I'm being told the prelim was done wrong after I have signed everything and that is nothing they can do for me on some of these jobs. There is another GC I need to file a lien on before I can't that money either. What do I need to do to take the proper steps to get my money? please help...Read More

We did a project in 2020 for a client and it ended successfully and without issue. In 2021 he had a pipe freeze and burst in his kitchen. He was out of the country and we had below zero temps and he hadn’t shut his water off. We turned in an insurance claim and they covered it. He called us back to make the repairs and now he is not paying us. There was no formal contract as we didn’t know what we were doing until we arrived on the job site. He supplied most material. Have text messages asking us to repair for him but when it came time to be paid he said he paid us enough with he first job in 2020 that we should have money left over to cover it. He knows we didn’t because we did a recap for him previously. When we sent him the breakdown of 2020 job w invoices, showing we went over budget by $24.00 he said he would have his accountant review but it’s tax season so it’ll take awhile. We are going on 10 weeks since work completed. When we said we’d need to be paid or we’ll have to start the lien process he said it was our fault the flood happened and that he would sue us and we’d lose. He owes us $8900. The previous renovation was $250,000. He knows he owes us money because he sent our designer an email saying he needed receipts from her so he could get us paid. The $250,000 job was fully permitted, licensed subs in all areas and passed all inspections. He says now it’s terrible work but prior to this we never heard one bad thing about our work. I'm a Restoration Firm working a residential fire claim (Insurance claim). Date of Loss 11/11/21 in which we began work stabilizing and clean up. After receiving Asbestos survey determined Abatement of such had to occur. I subcontracted the abatement work which occurred 12/14/21 through 12/18/21 and was invoiced to insured separately from the other restoration work. The Restoration work which was final invoiced in January 2022 contains restoration work both preceding the abatement invoice as well as post abatement invoice. Having filed a Lien on the Abatement Invoice only at this time (as the carrier has yet to pay) the insured has requested a "waiver". I'm in the process of filling out the "Georgia - Interim Waiver and Release Upon Payment (Progress Payment)" and I'm hung up on the language "The mechanic and/or materialman waives and releases any and all liens or claims of liens it has upon the foregoing described property or any rights against any labor and/or material bond through the date of 12/18/2021". The "Through the date of" would include any work performed PRIOR to said date which I fear would include a portion of my work which occurred prior and is invoiced separately. Am I correct to fear as written I could potentially be releasing them from costs incurred Prior to the 18th? I am a homeowner. I hired a general contractor to complete renovations on my property and want to make sure that I am protected against any subcontractors etc. placing a lien on my property in case they are not paid by the general contractor that I am hiring. I will be able to prove payment to my general contractor through my receipts but have heard that I could still be liable if they don't pay the subcontractors. Can you clarify this for me and let me know what I can do to protect myself? Also, please let me know if there is a time limit to any liens being placed on my property after the work is completed. On a current construction project, the title company is requiring conditionals and unconditional lien waivers for "lienable services" for vendors such as architects, engineers, surveyors, design professionals, and construction managers. These vendors do not provide furnished materials and do not contribute to any physical construction of the property. I thought lien waivers were only required for sub contractors who do physical work on the property. We have a project where the Owner, along with (2) subs owe us. The subs won't pay us because the owner is refusing to pay any more than the contracted amount to them and says they should have paid us with that money. The owners still need to use our company on future projects so they are going to pay us their portion owed and want us to sign a lien release. If we do that, does that mean we can't file against the project for the (2) subs that owe us money as well?...Read More

I paid a contractor in full for his work although it wasn’t finished and he had some rework he agreed to do in writing. Four days later he sent a letter claiming he was owed more money on work he agreed to do on the original contract. And for supplies. We had already paid $10k which was his full original price and almost the same in materials. And he asked for $8100 more claiming it was for rework which again we never discussed... There was no change order or discussion about his added monies. We refused to pay his outlandish bill. We found out a year and a half later during refi he had put a claim of lien on our property. We were never given notice on the filing Nor was there any legal action taken to enforce the lien. What are our options to get that removed without paying him money for work he never did? We are now 7 days away from closing and will lose our rate lock and potentialLy a mortgage savings of $730 per month if he does not release the lien.
