I'm not being fully paid on a residential project. I reached out to the owner of project and advised a lien would take place. I was advised a full lien waiver was signed by GC on job. The GC did make a partial payment to us but we never signed a waiver or was even asked to sign one. The owner basically told us there is nothing we can do to them and they aren't paying any thing. That we need to work it out with GC as they have been fully paid. How do I proceed now?...Read More

We have filed a lien for a project in Fort Worth, TX. The GC has advised the following: Once the Waiver has been executed, please have the Tarrant County Clerk attach it to the Lien and provide me with a copy of documentation of the attachment (normally notarized/stamped receipt). My family received a mechanics lien from a construction business we have never worked with. When we reached out to the business to get details on the work they believed they had done, we received no response. I have completed a notice of contest for the Georgia clerk's office but I want to make sure I submit to the necessary parties. Should I submit it to the clerk's office only or should I send a copy to the business' address on the lien? Also, what steps should I take after the 60-90 days if no response has been received? A former tenant has filed a construction lien on my property he used to rent in retaliation for not renewing his lease. He now fraudulently claims he worked on the property as a handyman and was never paid. He is not a licensed contractor or a sub, no NOC was ever filed, no permits were ever pulled, he wanted to paint his room and got my permission to paint and I supplied the paint for him. He also took the liberty to do minor repairs on his own, fix outlets etc. without permission and to install patio enclosure without my permission. I was contact by a mitigation company said a lien was filed two years ago ( without my knowledge ) on a roof job that’s was completed and paid thru insurance 3 years ago. It’s a total surprise for me and the amount is $2000. I felt being scammed but don’t want to take it lightly. What option do I have? Do I ignore the mitigation company or ? What if the company filing the lien did work on the property from 2016-2021 but their license expired in 2019. Are they still able to file the lien? They continued the construction while unlicensed. In other words, they started the work with a license but it expired in the middle of the construction and they kept working without it. ...Read More

Hello Support, I hope this message finds you well. I had contracted a Painting(Garage & Laundry room and Garage Epoxy Flooring) to a local contractor in Florida (Brevard County). The total cost of the project was about $1850 dollars. The scope of the project outlined in the initial estimate was not followed precisely, but I choose to follow the contractor's professional advice. The issues that arise stem mainly from the epoxy part of the job, having several air pockets on the floor resulting from epoxy not adhering properly. After having a call with Sherwin Williams(Brand of Expoy used) agent, she advised that epoxy should not be poured onto fresh concrete or should be given weeks of drying time before doing so. The pouring of fresh concrete was not part of the scope of the project and it replaced 'repairing of cracks' and acid washing and scoffing the concrete. Anyway, the contractor dealt with all of my objects and the job became almost salvageable. The final aspect of adding the prescribed amount of clear coat (3) was not done in a timely fashion or as per the product specification required. Sherwin William's brand of epoxy clear coat requires additional coats to be added before 72 hours window. Here is the contractor took weeks to respond back to my message after I advised him that I'll get someone else to do finish or redo the job. He finally replied and hurried someone to come finish the job. I told him no one is touching the job unless the specification of Sherwin William is followed;re-scoff before adding clear coat since it was way beyond the application window. He then threatened a Lien on the property via Text. However, we came to an agreement that if he would take the risk of adding the clearcoat and everything turn out favorable after 72 hours he will be paid and so far the finish looks fine. Now before paying him, I need a legal instrument that would protect me from any future threats, and so i was looking at your conditional waiver. Is this the right legal instrument to use? I am a general contractor I filed a lein on one of my customers property that owes me money they never fulfilled the contract or paid me in full on the change order and my contract, we were gone for the holidays I just got back and I missed my court hearing date to defend the lean in court against the homeowner . The lean was released and now I am responsible for the attorney fees as well. The basis for releasing the lean was I did not file it in the timely manner which is the 90 days, This is not true I have all of my paperwork in order which shows the dates it was filed properly I did send a preliminary notice what can I do next how do I refile the lein?...Read More

hello . Please help i am trying to sell my deceased mother home. The title company has found a mechanic lien on the house thats dated 25 years ago. I have tried to contact the company it no longer exit the person is deceased that filed it. The title company back then no longer exit. The now title company says HUD has it. I contacted HUD main office in Washington DC. They have no record of no lien in my Mother name. The house is about to be foreclosed soon. I wanted the money to get my mother headstone.
