We have a lien filed on a project, and we're about 3 weeks away from needing to foreclose. The client offered to pay 75% of the balance at this time to continue the project. Will accepting the partial payment compromise the lien in any way? Do we need to submit a new balance due for the lien? Also, is there template language that I can use to respond stating that we still need the remaining balance paid before our foreclosure deadline runs out?...Read More

Hello, I am a property owner in South Dakota. It has been 9 months since I paid a 50 % down payment to the general contractor to get a bedroom/ bathroom remodel done. The first crew of subcontractors walked off the job in October 2021 after multiple delays, disputes and stoppages. The GC hired a second subcontractor crew to complete the job. I paid an additional 25% to GC at that time. Today, March 2022 there is still final finish work, some electrical and light installations and all of the plumbing fixtures to be installed. Today the replacement subcontractor informs me he has not been paid for several weeks of work by the GC and is filing a lien against my property. What are your recommended next steps? I am a homeowner. I hired a general contractor to complete renovations on my property and want to make sure that I am protected against any subcontractors etc. placing a lien on my property in case they are not paid by the general contractor that I am hiring. I will be able to prove payment to my general contractor through my receipts but have heard that I could still be liable if they don't pay the subcontractors. My dad was about the closing table to sell his home and the lenders happen to find an SBA lien on his home that the previous owner had on it before my dad purchased the home. So his buyer's lending company does not want to move forward until the lien is removed which is about $10,000. Hello. We had work done on our backyard where the contractor poorly installed our artificial grass. After confronting him about it he came back with some union workers and mad the matter worst. He was paid in full for what was agreed to. Now he have put a mechanic lien on our property for the work he came back to try and fix his mistake. The price he’s asking for is $3,000. I have been dealing with two solar companies because they had sold me a solar panel system. In the end, a week later I decided to cancel the contract with Titan Solar because I decided that I didn’t need/want any solar panels and it would be too expensive. I had no problem and was able to cancel with Titan Solar because no work had started (no survey, no permits, or installation). But there’s a subcontractor (Solar Energy Auditors) that now is threatening and harassing me via phone and text that they want to put a lien on my property because they say that I owe them a 20% restocking fee ($12,000) because they had ordered the panels. They have even sent me a Notice to Owner letting me know that they will put a lien on my property. I filed a lien on a job. Now all of the sudden my contractor wants me to sign a lien waiver because the bonding agency, owner, general contractor, and material provider all are trying to get paid. My contractor sent over a lien release form. Do I legally have to sign and return this form without being paid first? My concern is that if I sign this the contractor will not provide the check owed. To whom it may concern, I filed a lien against a contractor for the non payment of one weeks worth of work. I received a call from the material provider last week. They are who hired the installer who contracted me for part of the install. Then later that day the contractor who hired me was emailing me asking for COI’s stating that is the reason why I had not been paid. So within 24hrs I sent over my COI’s. Now he has sent me a lien release form. It states that if I sign the waiver I will be paid. I have already file the lien, will signing this release negate my lien?
