i am an unpaid sub on a job. Freedom Mortgage is holding a final draw on the property. i could not get homeowner to agree to pay me so i filed. now that i filed, we have agreed to paying me out of the final draw from the bank. The bank however wants me to record the NJ release of unpaid balance form BEFORE the money can be distributed to the GC/Homeowner. I am currently building a home. We terminated the contract with the builder due to material breaches of the build contract. Now, the bank with whom we have the construction loan requires the old builder to sign an All Bills Paid affidavit, as well as the Transfer of Mechanics Lien document to the new builder. The old builder is refusing to sign these documents, despite the fact that everyone has been paid. Sour apples, if you will. But it's holding up the entire process. The customer claims my work had to be redone...I know for a fact that they're lying. I did the cabinets, and have been in contact with the countertop guy. They didn't remove anything and are putting finish on it now. They got 33k in extras before terminating me. I have a question that I can’t find the answer to regarding the timing of vendor releases. Here’s the scenario. I’m a first-tier sub to a general contractor and I turn in my progress billing on the 20th of each month with a conditional releases. I then soon after start the process of requesting an Unconditional Progress Release from each of my vendors for the previous month. When I have all of my vendor releases, I give them to the general contractor and they release my payment. The exception is for my first billing as the vendors will not have filed prelim and I get paid without any vendor releases. This is how it’s been for me for the last 20 years as best I can remember. I now have a new project with general contractor that is requiring that my vendor releases be through the same month that I am billing before they will release my check. My argument to them is, “you are getting paid by the owner without my Unconditional Progress release for the same month.” Thank you for your time.
