I file a prelim notice on a construction job. Am I REQUIRED to automatically send a Conditional or Unconditional Progress Release form to the contractor every month? I normally do only when requested and stated that to them. I am being told by one contractor that I am required by prelim law to send every month since I prelimed their job whether they ask or not. It is not specified in their contract either. Thank you

KentuckyWe have a laborer who is not honoring the written proposal cost and suggests he should be paid more than the proposal he originally wrote up and agreed to. Now that it is time for him to accept the final payment, he refuses to. All the bookkeeping and calculations are in full detail and correct, but he continues to disregard the evidence and demand he is paid more without reason. Can he put a lien on the house if he is not paid for the overcharged amount he is asking for and if so, can I fight against it to show he is abusing the power to put a lien on the home??

VirginiaI had a subcontractor file a lien on a property. Since then, he has been paid in full and acknowledged that he will return the lien release. Since he got paid, he won’t respond to phone calls or emails. The final payment cleared my bank on Sept 30, 2020. How can I get this lien removed now that he won’t respond?
TexasI'd like to know what the statue states about my rights. I've requested a final conditional release for residential project. They came back stating the following: " Because the proposal does not state a Conditional waiver is required prior to payment being released, XXXXX will stick to its standard practices and release a Conditional Waiver for Progress Payment after receiving the payment requested. If you wish to pick up the Conditional Waiver and deliver payment in full (InvoiceXXX & XXX) XXX can then issue a Conditional Waiver for Final payment." Could I still request a conditional even though it was not in the proposal?

ArkansasI won a small claims suit against my contractor for breach of contract and damages to my property. They filed a mechanics lien and wont take if off after I won my lawsuit. Now that I won judgement against them, doesn't that make the lien invalid? How do I get it released?
ColoradoHello, I have an invalid mechanics lien on my property I need removed. A contractor filed it after his email was hacked. He had fraudulent payment instructions sent from his account and claims he was not paid. However the funds were sent via instructions from his email to a bank account with his business name. I have an open police investigation with a local detective. The banks will not refund my money so he put a lien on my property. I need this lien removed as I need to apply for a home equity loan and possibly sell in the near future. He did not file a preliminary 20 day notice and he did not file a notice of completion. He filed this invalid lien 90 days after completion. The hack and fraudulent information is his liability and he is causing me a lot of financial harm with this lien. It is for $25,000 which I paid. I am not paying him again. Thank you.
