I'm a homeowner in Iowa who hired a general contractor to complete repairs for an insurance claim. The general contractor hired a sub-contractor to complete part of the project. No bill has been sent by the general contractor, and the project isn't yet completed, but the sub-contractor filed a mechanical lien as a general contractor 2 business days after their part of the job was completed, presumably to force the general contractor to pay them ahead of us receiving the final bill? The 'prior notice' and the 'notice' arrived in the mail on the same day. But now, as a homeowner, I don't know who to pay, nor how much to pay them. What protection do I have in the situation of what's presumably a frivolously filed lien? What protections does my general contractor have? Who do we pay? If we pay the general contractor, how can we be sure the lien claimant will be paid? My wife and I don't want to be stuck paying the bill twice, and are anxious that this will reflect poorly on us when we're open, willing, and able to pay for completed work. ...Read More

The contractors that did work on my home did extremely bad work. About halfway into the work they were doing (completely tearing down and redoing my back porch) I realized they had not obtained any permits from the city. When I asked them about it, they told me they didn't need permits - which is untrue. After they realized I demanded permits for them to continue, they left, never came back and never responded to any of my calls, emails or letters. Shortly after, they put a lien on my home. We lien a project, was informed we needed to lien each lot not just the project. We have received payment on 5 lots out of 9. The project contractor needs us to release the lots that have been paid to sale them. I am being informed due to being in Riverside County in CA, we are not able to release or modify our lien without risking the lien in whole. I would like to refinance, and have a mechanics lien on my home from 10/2015 for 8k. The contractor was given a stop work order and botched so many things I had to hire people to repair the poor workmanship. In Michigan it is only enforceable for 1 year. Do I need to initiate legal action to get it removed or whill I be able to refi without issue?...Read More

Good morning. We are a Electrical Contractor in Fl and I have a question regarding conditional releases. We routinely setup job accounts with suppliers. The suppliers in turn issue NTO's to owners and the GC's. We have had a few situations where the GC with withhold payment (to us) until they receive a unconditional release from said supplier. We pay the supplier with the monies received from the GC so we are in a constant loop where the GC will withold payment to us until we pay our supplier. Is this legal? Is there a workaround for this? I am an architect working with a general contractor in CA. He is terrible at paperwork, and does not want to submit lien releases, in part because he does not want to have to figure out to whom he has paid what. Can the subcontractors submit unconditional releases just saying they were "pain in full" rather than entering a specific amount? If not, what if the amount shown is incorrect? Thanks!...Read More

I am a sub for a GC and just got a request to sign and notarize a Partial Release of Lien which reads: "The undersigned lienor, in consideration of the sum of Check #5090. Received, hereby partially waives and releases its lien and right to claim of lien for labor services and/or materials Furnished through November 23, 2020...." The job is only half way finished and GC is not answering to schedule rest of job. Is this a normal practice or does GC have some arterial motive or trying to get rid of me?...Read More

I have a question about a lien I already enforced; total amount of this lien was for 314k, but the customer wants to make payment plan for this. Initial payment would be 100k, and then another 100k the next month, and so on. my question is : once this project was lien, can we stop the lien, and re-lien for a shorter amount? in case the customer does not pay as agreed the remaining amount? I need some explanation how to handle this type of situation where the customer cant pay the total amount of the lien, but agreed to be on payment plan. thank you....Read More

I was never issued a NTO from the GC roofer but was notified of a lien 4 months after the job started. I contested the lien and never received any response from the roofer in the 60 days period and still have not. All inspections on my new construction was done through a Private provider hired by my GC. This has been a 18 months process due all other liens and my builder not willing to care of his obligation. We have paid over $30,000 of other valid liens and other cost trying to get this construction finished on our own but under the builder permit. We are finally at the end stage and all inspections have pass including the roof but now was told by the PP and builder that we could not apply for the CO without a roofer attach to the permit and sign off on by the roofer which we can't get. The city of Cape Coral advised without this they never will be able to issue us a CO. This is on top of all the aggravations we went through the last 18 months from the lender not asking for liens waivers, been notified by us that the subs were not getting , finally stopping the draws , also agreeing for us to keep the construction going but not releasing the funds causing us law suit and costly attorney fees and penalty to the liens holders and also charging us more interest and extension penalties. Also we had to convince the city to ask the builders to ask for revisions to the original plans since the builder didn't follow them and the PP never inspected according to them either. Anyway just wondering how we can keep the roofer from holding up our CO....Read More

my wife and i live in Pennsylvania. Her brother died in January 2020 without a will (intestate) and filed in county court for probate and was awarded personal representative. The house was listed and has an agreement but the title company found a property lien for unpaid work in 2014. I contacted the contractor and negotiated a $10,000. settlement but the title company states that the lien filing law firm needs to receive the check than forward to the contractor. The law firm now wants $2,500. for the lien removal processing which sounds outrageous!!...Read More

I have a written document that he agrees the job is not completed as agreed. His lawyer filed a lean on my property saying either I have to pay in full or agree to demolish the built shed.
