I had a $19,000 contract with a contractor to dig a pond in OK. I paid him $13,000 upfront. He did not complete the job. He did not pay the rental co. for the equipment he rented.
The rental co. never informed me that the contractor was in arrears in payment. I never knew that the contractor was renting the equipment.
My contract with the contractor was for $19,000. The lien on my property by the rental co. is for $50,000+.
The contractor, after the fact, told me he thought his rental contract was for hours used on the equipment. He let the equipment sit idle for months and was charged a weekly rate.
The contractor has filed for ch. 7 bankruptcy. He has no assets that can be distributed....Read More

The Arizona waiver has wording that states for all labor, services, equipment or material furnished to the jobsite or to --------------- . My question is since it is saying to the JOBSITE are we releasing other parties that we may have supplied equipment to on the same project. We have been advised that we should not be signing it with that verbiage as it could release the whole jobsite, not just our customer.

I am a homeowner and started my pool build in May 2020, it is now 10 months later and my pool is still incomplete. Additionally, the workmanship of the Pool Builder (PB) and his team is very lacking. At this point, I have a gunite shell, incomplete deck and missing pool tiles, not to mention the countless other questionable things that have occurred. It all came to a head when they expected me to pay for an incomplete deck. When I indicated, I would not and that I expected them to complete the job, they promised to take care of it for a week, before sending someone over to work on it for a few hours leaving it in worse shape than it was in prior. I have since fired them and now they are threatening to put a lien on my home because of a NOC currently on file. I recently learned that by law the contract should have been voided because I paid more than 10% down and they took 2 months to apply for the permit. At this point, I've paid them 3/4 of the cost of the pool and in order for me to finish on my own, I will have to pay in excess of $20,000. I am currently mid-project, and the work by the contractor does not meet code, is generally shoddy, and the original contractor has begun to sub-contract out the work to temp agency hires.
