hi our customer has requested ac waiver on the form they provided...State of New Mexico, Final Waiver of lien to date. The amount of one paid inv. is listed on it, also thru 2/28... there is an open inv on 1/22/21 still. Also the owner listed is somewhat different than what we have???
New MexicoI paid a contractor to dig a pond. He didn't complete the job and he didn't pay a equipment rental company . The rental company filed a lien on my property. Contractor filed ch 7 bankruptcy and has no assets . His debt is cancelled. Will the lien on my property be removed.
TexasI had a $19,000 contract with a contractor to dig a pond in OK. I paid him $13,000 upfront. He did not complete the job. He did not pay the rental co. for the equipment he rented.
The rental co. never informed me that the contractor was in arrears in payment. I never knew that the contractor was renting the equipment.
My contract with the contractor was for $19,000. The lien on my property by the rental co. is for $50,000+.
The contractor, after the fact, told me he thought his rental contract was for hours used on the equipment. He let the equipment sit idle for months and was charged a weekly rate.
The contractor has filed for ch. 7 bankruptcy. He has no assets that can be distributed.
OklahomaHi, are CA property owners legally entitled to lien waivers and releases or does this entitlement need to be set forth in the contract? If so, where does the law or case law provide this entitlement?
CaliforniaJan 11, 2021 I send out a pre lien and I just completed the lath on a exterior and send out my payment on April 2,2021, do I need to send out a notice to intend to lien or send a mechanics lien before the 90 days dateline ?

UtahIs it typical to collect $0 lien waivers monthly in Arizona for Preliminary Notice filers who aren't owed any money in that period?
ArizonaThe Arizona waiver has wording that states for all labor, services, equipment or material furnished to the jobsite or to --------------- . My question is since it is saying to the JOBSITE are we releasing other parties that we may have supplied equipment to on the same project. We have been advised that we should not be signing it with that verbiage as it could release the whole jobsite, not just our customer.
ArizonaI am a homeowner and started my pool build in May 2020, it is now 10 months later and my pool is still incomplete. Additionally, the workmanship of the Pool Builder (PB) and his team is very lacking. At this point, I have a gunite shell, incomplete deck and missing pool tiles, not to mention the countless other questionable things that have occurred. It all came to a head when they expected me to pay for an incomplete deck. When I indicated, I would not and that I expected them to complete the job, they promised to take care of it for a week, before sending someone over to work on it for a few hours leaving it in worse shape than it was in prior. I have since fired them and now they are threatening to put a lien on my home because of a NOC currently on file. I recently learned that by law the contract should have been voided because I paid more than 10% down and they took 2 months to apply for the permit. At this point, I've paid them 3/4 of the cost of the pool and in order for me to finish on my own, I will have to pay in excess of $20,000. I believe they should be liable...What are my options?
FloridaIf I buy a Florida parcel of land at auction with a tax deed, and there is a defaulted mortgage on the parcel, am I responsible for the balance of the mortgage? Would I be able to eventually get a "Warranty Deed"? When would that defaulted mortgage be cleared from the title?
FloridaI am currently mid-project, and the work by the contractor does not meet code, is generally shoddy, and the original contractor has begun to sub-contract out the work to temp agency hires. I've paid approximately a third of the original quote, and I'd like to have them simply stop where it is and take what I've paid so far as final payment, so that I can get a better quality contractor in to complete the project, but not end up with a lien. My "contract" with them consisted of receiving a quote and making an initial payment against an Intuit Quickbooks invoice.

CaliforniaI have sent the contractor a written request asking that he remove the lien, and he has not responded. The lien is over 6 months old, well over the 90 day limit. I would love to do the process myself but will hire someone if necessary.
