Hello, my company is having trouble collecting on a 5 month past due account in the amount of $90,171.66. We have made multiple attempts trying to call the owner and several different other people that pertain to this project, but as of yet no response. We have not sent any prerequisite documents (Conditional Waiver or Prelim) but do need to move further with this account. I gave a cash/loan to my son-in-law ((and daughter) back in 2017 to purchase a new townhouse in Winter Garden. They paid back approximately half the loan in 2018, the other half is still not refunded. They may be getting divorced (2021) and i am still waiting to get my money back. I need to record a lien on the townhouse to protect my money in case they sell it anytime soon. I called Orange County Comptroller county office & they said i can record the lean as soon as i fill in the Claim , notarize it then submit it with the fees required per page ($10 for the 1st page, $8 per extra page(s). I CONTRACTED A JOB AND FILED THE LIEN A FEW WEEKS AGO AND THE GUY DID NOT PAY ME ON THE CONTRACT TERMS AND ALSO PERFORMED WORK ON THE PROPERTY AND THEY REFUSED TO PAY ME. WHEN I WENT TO GET MY TOOLS THEY DAMAGED ALL OF THEM BRAND NEW TABLE SAW, MITER SAW, AIR COMPRESSOR, 4 DAYS OLD GENERATOR THEY TORE THE GAS CAP OFF OF TOOLS HAD DIRT ALL OVER THEM EVERYTHING BENT IN SOME WAY SO IT BASICALLY SHUT DOWN MY WAY OF LIVING. Im the co owner of a general contractor construction company, our firm completed an interior home improvement job in city of diamond bar, CA to a couple clients on or about 12/14/2020 to 1/29/2021 . The owners failure to pay $ 20k included materiel with the proof of receipts to us. I tried to ask them to pay via email, text messages etc in properly languages, the owner did runarounds with us, also bullying and threaten my firm, and asked my firm to continue to do some cosmetic repairs to their premise. I asked the owners to pay off arrearages first, then I would to help to do extra touch up or cosmetic repairs. But the owners refused to and not reply to my inquires any more since on or about 2/19. on 3/5 , I received an attorney letter form this group of owners, they asked my company to credit them $10k.... Hi i moved into a property that i was told needed some work but that it was very minimal.When i moved in with time i found out the whole roof was needing to be replaced and alot of the structure was infested with termites.I explained this to the owner who stated he didnt have insurance so he was going to sell the property to me instead.Well 7 months in he decides he wants the remaining balance in one lump sum i ckearly didnt have it.i inly owed $6,000 to own the place.Long dtory short he decided to back out and is trying to evict me after i have done over 10,000 in work to the place.Should i file a lean?He used me to just fix the place then try to sell it for more and kick me out after i put all my money into the place....Read More

I filed a mechanics lien on a job that didn't want to pay me. I then was not aware i needed to file suit and never did file suit. It seems that the lien has been expired. i am now being sued to get the lien released which i thought i already did. i am also being sued for the lawyer costs the homeowner has incurred. do i need to file a new lien release or since it has expired do i need to do anything at all?...Read More

Iam a residential subcontractor. I was hired by a GC to reside, reroof & install new soffit and fascia on a residential property in cloquet mn. I never received a down a payment and I never filed a intent to lien notice to the gc or the home owner. The project was started on Nov 20th 2020. The last day I worked was jan 26th and at that point the project was 99% completed. The home was inspected by the city building inspector and passed. We ran short on a few materials to finish the job 100% and they were a couple weeks out after ordering them. So I submitted an invoice for $14,000 roughly to the general contractor only for the work that was completed. The contractor then tells me that he will not be paying until the project is completed. But tells me that the homeowner and himself do not want me on the property till after they can meet on Feb 4th to see how they wanna proceed with the project because there are some quality of work being disputed. (Mind you the city building inspector already passed the work as it was done to meet mn building code) also feb 4th just so happened to be 45 buisness days from the first day work was furnished. So I didn't realize that till afterwards and now they meet and are saying that there is only $3800.00 roughly of undisputed work that they are willing to pay me and want me to sign a lien release form apon paying me. A disabled neighbor of ours found out we were selling our house in Onondaga County NY. The short story is, he put a lien on the house claiming he worked on it. He never wrote what he did (which somehow the County clerks ignored), so it's hard to enforce the 'you need a license for that work'. The lien amazingly enough, for a guy in a wheelchair who used to visit us for attention, lifts to the grocery store etc.. is $10,000, I kid you not. He's not a contractor, he can't get out of his wheelchair, but the county 'sustained his right to file the fake lien'. We know about bonding the lien. But that holds up our resources at the end of the sale for a whole year. WHO in this county can we reach out to? The clerks who took the fake lien, even the lawyer for the clerks office were all no help at all.. EVEN though they know the man (he's an alcoholic). Even though he didn['t fill out the lien correctly (It's a mess.. he never said what work he did, and 2x he put his own name where the lien asks 'who did you do the work for). (PS.. He is not a contractor, and filed this without a license. (how is that possible?) he lives on Social security, who may want to know about his 'earnings'. We did call the police, and will have a police report in a day or so, because when this man was drunk, he let slip that he's done this before. He may be a serial extortionist for all we know. Maybe he gets a $1,000 or so, just so people can get him off their back, and out of their closings... What can we do?...Read More
