I did some work for a friend, remodeled a house he owns in Arizona, where I have also been living . We have a mostly amicable relationship...but we discussed I should file a lien on a property (Single Family Home) he owns in New Mexico...to be sure, in case he dies, or some other unexpected thing might come up...that I can get the $100K I'm owed for the work I've done on the house in AZ. So I filed the lien on his property in NM...for $80K ...rather than the full amount...b/c we have been considering whether or not I should get the rest of what I'm owed for the work I did, in the form of payment...or whether we'll apply that (remaining $20K) in the form of my owning a share of equity in the property in AZ. We haven't decided about that yet. So...I'm wondering if it might be in my best interest to file a lien on the AZ property, too....and maybe for the full amount of the $100K. Would the fact that I've already filed a lien (for the $80K) in a different state...somehow nullify or minimize the viability or legitimacy of a second lien (I might file) for the full amount in AZ? Is there anything else I should know about this? I'd be willing to pay an atty for a brief consult, but I'm single, 62 year old disabled woman, living on a VERY low fixed income, that is well-below the poverty level criteria. So, I don't really have any disposable income for paying professionals for these kinds of things. I fired a contractor who did not complete the full scope of my basement renovation in the time allowed (originally quoted 1 week, project dragged for 5 months). I have paid him in full for every line item that is 100% complete, and even paid him a discretionary amount for incomplete line items proportional to their completion.

An HOA ordered signage from us and the shipping address was listed as a PO Box, so the signage was delivered to the golf course within the HOA. I have proof of signage being delivered and they appear to be holding the signage hostage. I have a lien placed on a house which was listed for sale yesterday. I am considering contacting the Real Estate Agent to see if she can help getting the balance paid. Any downside to this? He refuses us to show us all of the invoices so we have no idea what happened to our money.He is building another house at the same time. We are a GC doing a job in Arizona. A cash advance company filed a UCC Lien on one of our subs working on this job. It looks like the cash advance company purchased the accounts receivables of our sub for a certain dollar amount, and the sub is now in default. We received a notice of the UCC Lien in the mail and it asks that we forward all funds owed to our sub to the firm representing this cash advance company instead. The UCC lien states that they are aware we owe the sub money, which we do as it's an ongoing job, but the lien does not mention our project at all.
As the GC, we are wary of this and unsure how to proceed. This agreement between our sub and the cash advance company does not include us or our project, and we are not in contract with this 3rd party. We are obligated to pay our sub as we are in contract with them, not this 3rd party. If we don't forward the funds and our sub does not pay the cash advance company, can the cash advance company file a lien on our job? Should we look into issuing joint checks going forward between the sub and cash advance firm? How do we, as the GC, protect ourselves in this situation?...Read More
I just received a claim of lien on my property. There are many things wrong with this. The lawn company was supposed to perform the work in March 2021 and never showed. A couple weeks into April we came home and the work was done, being generous lets say it was April 15 (most likely a few days before). I thought their communication sucked but the work was done. I called them numerous times between April and now asking for a bill or how to pay. I always got a voicemail never got response. I have never seen a bill or a phone call from them, totally willing to pay for the service but don't know how without a bill or address to mail a check etc. Their website just has phone number and email. Today I received the claim of lien. The claim of lien still doesn't tell me where to pay. I called and left a message again today. I then looked up rules and if I'm correct he would have had to complete the work on June 25th or later to be able to file this lien. Is it best to try and dispute this now or should I wait to see if he sues me? I'm beyond mad. I would have used him all summer but he was horrible.
